Introduction for first reading of Ordinance No. 595, An Ordinance adding day care centers and <br />group nurseries as a Conditional Use in the B-1, B-2, B-3, B-4 and I-1 Zoning Districts. <br />MOTION/SECOND: Trade/Quick to remove this item from the Table for discussion. <br />VOTE: 5 ayes 0 nays Motion Carried <br />Ms. Sheldon noted this ordinance would add day care centers and group nurseries as a Conditional Use in the <br />B-1, B-2, B-3, B-4 and I-1 Zoning Districts. At the present time, the City Ordinance allows for day care <br />centers and group nurseries in the residential district. This would add them to the business and industrial <br />district. She noted that two issues of concern addressed at the February 24th Public Hearing were the higher <br />level of exhaust fumes for children of day care centers located in areas of higher traffic volumes, and whether or <br />not a distance requirement should be established between day care centers/group nurseries and businesses <br />serving liquor, liquor stores and adult establishments. <br />• With respect to vehicle fumes, Ms. Sheldon noted that the City's ordinance does require that day Gaze <br />centers/group nurseries be located on arterial or collector streets rather than local streets (she believes this was <br />to try to keep heavier traffic out of the residential neighborhoods). In talking with the Air Pollution Control <br />District, it was their estimate that with a 200 foot distance between the play area and the traffic/intersection, <br />sufficient disbursal of the fumes would eliminate the hazard. Therefore, it would be Ms. Sheldon's <br />recommendation that a criteria be added to require that the play area be at least 200 feet from the right of way <br />of Highway 10. <br />In regard to distance requirements, criteria could be added to state that a 500 foot distance is needed between <br />any day Gaze center/group nursery from establishments have either a liquor license or licenses for adult <br />businesses. Ms. Sheldon noted that the distance requirements could be adopted for just the business and <br />industrial district, or could also be added to the residential districts, with a provision that existing day care <br />centers will not be made non-conforming. She noted that the criteria proposed would not apply to home day <br />care. <br />MOTION/SECOND: Trude/Koopmeiners to Approve the Introduction of Ordinance No. 595, An Ordinance <br />adding day care centers and group nurseries as a conditional uses in the B-1, B-2, B-3, B-4 and I-1 zoning <br />districts, Option #2, and to waive the reading. <br />ROLL CALL VOTE: <br />Mayor McCarty aye <br />Council member Koopmeiners aye <br />Council member Quick aye <br />Council member Trade aye <br />Council member Stigney aye <br />• Motion Carried (5 - 0) <br />
