The Developer is agreeable. <br />On Lot 1, sod will be installed around the building and dog park. <br />Seed (prairie mix) will be installed north of the driveway. Staff <br />recommends the addition of a pollinator seed mix. The Developer <br />is agreeable (November 3, 2021 Planning Commission <br />discussion). <br />The Landscape Plan, dated October 4, 2021, proposes two trees <br />south of the parking lot, on Lot 2 (Bio-Clean). 9 The Developer <br />has agreed to amend the Landscaping Plan (November 3, 2021 <br />Planning Commission discussion). <br />On Lot 1, there is a sidewalk and bench (e.g. smoker's bench) <br />located in the SW corner of the lot with a 1' setback, whereas 2' is <br />the minimum required. Staff is supportive of the encroachment <br />(versus narrowing the sidewalk, or parking lot). The landscaping <br />around the bench encroaches into Lot 2 (Bio-Clean). The <br />Developer has agreed to adjust so that all is on Lot 1 (November <br />3, 2021 Planning Commission discussion). <br />Wetlands There is a wetland in the NW area of Lot 1. A Wetland Alteration <br />Permit is required for land disturbance within 100' of a wetland. <br />There is a minimum 100' building setback from a wetland, unless <br />a lesser setback is approved through a Wetland Alteration <br />Permit.10 11 The proposed apartment building is set back about <br />95' from the wetland. Staff is supportive of this encroachment. <br />A Wetland Alteration Permit requires12 (summarized) that the <br />project not reduce the flood storage capacity of the wetland, or <br />reduce the wetland water quality or wildlife habitat value, and be in <br />compliance with the Local Water Management Plan. The Wetland <br />Alteration Permit is duplicative of the Watershed Permit (joint <br />City/RCWD review). For the Watershed Permit review, the project <br />reduces drainage into the wetland by 75% 13 Staff (Stantec) has <br />provided recommendations to increase drainage (this will be <br />handled via the Watershed Permit). <br />Utilities Utilities serving residential customers must be underground.14 <br />Driveway Driveway access will be onto Old Highway 8.
