The Developer shall submit a Landscape Escrow equal to 150% of the cost of <br />landscape materials and labor, prior to the City releasing the mylars for <br />recording. <br />6. The Developer shall pay a Park Dedication Fee of; (1) $420,000 for Lot 1 (The <br />Villas of Mounds View, Limited Partnership); and (2) $5,945 for Lot 2 (Gregory <br />Kelley and Jane Kelley). Fees shall be paid prior to the City releasing the Final <br />Plat mylars for recording.. <br />7. All new electrical distribution lines, telephone service lines and other utilities <br />proving services to residential customers of the plat shall be buried underground, <br />consistent with Mounds View City Code §158.0049(A)(1). <br />8. Approval of the Preliminary/Final Plat and Development Review shall constitute <br />approval of a Wetland Buffer Permit to allow the planned apartment building (Lot <br />1) to encroach within the 100' setback of a wetland, consistent with City Code <br />159.007(C)(3), and consistent with the Site Plan, dated October 4, 2021. <br />NOW, THEREFORE BE IT FURTHER RESOLVED THAT the Planning <br />Commission makes the following Findings (italics) in support of its recommendation for <br />approval of a Planned Unit Development for Lot 1 (The Villas of Mounds View), <br />consistent with Mounds View City Code 160.318(C)(6) ([Development Stage] Review <br />and evaluation criteria; and Final Plan): <br />Findings: <br />9. Adequate property control will be established. The Residential PUD will <br />consist of Lot 1 (The Villas of Mounds View). The PUD will not include <br />any outlots, nor land owned by an Owners Association. <br />10. The parking lot's internal circulation has been reviewed by the SBM Fire <br />Department, and access onto Old Highway 8 approved by Ramsey <br />County Public Works. <br />11. A sufficient amount of Open Space is provided. Mounds View City Code <br />§160.056(B)(d) establishes a guideline that each multiple -family dwelling <br />site shall contain at least 625 square feet of usable open space intended <br />and maintained for either active or passive recreation (or both), and <br />accessible to all residents of the PUD. The project (Lot 1) includes 84,035 <br />square feet of non -impervious surfaces (700 square feet per unit). <br />12. The arrangement of buildings on Lot 1 does not unreasonably disturb the <br />privacy or property values of surrounding residential uses (e.g. <br />Townsedge Terrace). <br />
