The drainage and utility system plans are adequate, subject to approval of <br />the City of Mounds View/Rice Creek Watershed District (joint <br />application/review for watershed permit). <br />15. The development schedule, protecting the public's interest. <br />16. The development is in compliance with Mounds View City Code §§154 <br />(Floodplain Management), 155 (Surface Water Drainage Management <br />and Development Control), 156 (Construction Site and Land Disturbance <br />Runoff Control), 157 (Storm Drainage Systems), 158 (Wetland Zoning), <br />pending approvals of subsequent permits (with conditions). <br />17. Dwelling Unit and Accessory Use requirements are in compliance as a <br />Residential Planned Unit Development <br />NOW, THEREFORE BE IT FURTHER RESOLVED THAT the Planning <br />Commission in compliance with the Mounds View City Code §160.316(B), the Planning <br />Commission finds the project compliant with the Comprehensive Plan. The <br />Commission recommends approval of a Planned Unit Development for Lot 1 (The Villas <br />of Mounds View), with the following conditions: <br />18. The Developer shall agree to a Development Agreement, consistent with Mounds <br />View City Code §160.318(C)(4)(d) (PUD Agreement). <br />19. Construction shall commence within one year of this PUD approval (e.g. by <br />November 22, 2022), unless an extension is granted by the City Council, <br />consistent with Mounds View City Code §160.0318(D)(6) (Limitation of final plan <br />approval). <br />NOW, THEREFORE BE IT RESOLVED THAT the Planning Commission <br />recommends approval of a Development Review, consistent with the Mounds View City <br />Code §150.054 (Development Controls). A Development Review is required for all new <br />construction and building expansions of 10% or 10,000 sq ft. The Development Review <br />is specific to Lot 1 (The Villas of Mounds View), and includes the following conditions: <br />20. The Developer shall sign a Development Agreement. <br />21. The Developer (Lot 1) shall submit an exterior lighting plan, consistent with City <br />Code §160.031 (Glare). The Plan may be reviewed and approved <br />administratively, as part of the Building Permit plan review. <br />
