Service Options provided during the preceding quarter(excluding charges already paid <br /> by the RDU), dates of service, service address, billing address, credits, taxes, and <br /> payments received. <br /> 2-."2.6.7 Invoices not paid by the due date by RDUs are subject to a five percent (5%) <br /> monthly late fee which shall be imposed on the original notice of non-payment. The <br /> notice of non-payment and late fee shall be sent when payment has not been received <br /> by the beginning of the second month of service for the period being billed. For <br /> example,an invoice dated January 5th, and not paid by February 5th,would incur its <br /> first late fee on March 1st.The Hauler shall send 30-day notices and 60-day notices of <br /> non-payment to the RDU while the invoice is unpaid. <br /> 2.6.72.6.8 If an RDU disputes any charges,they must notify their Hauler in writing(email <br /> is acceptable) within thirty (30) days of the date of the invoice. Each invoice must <br /> explain the method for notice which must include a telephone number and email <br /> address.Except in cases where Hauler has made similar billing errors to 25%or more <br /> of RDUs, Hauler is not required to refund any charges for an RDU who failed to <br /> provide written notice of a disputed charge within thirty(30)days of the invoice date. <br /> Hauler shall directly pay the Trash Disposal Cost to the Trash Disposal Facility. <br /> 2:642.6.9 Hauler shall directly pay the Trash Disposal Cost to the Trash Disposal Facility. <br /> The Contract Price for Trash Disposal Service may be adjusted as set forth in this <br /> Contract to reflect actual changes in the Contracted Hauler Tipping Fee as adopted by <br /> Ramsey County at the REC. The actual Disposal Cost at the City's Trash Disposal <br /> Facility at the time of Contract execution will be defined as the benchmark disposal <br /> price.Documentation from the City's Trash Disposal Facility must be provided to the <br /> City. The benchmark Trash Disposal Price (i.e., the disposal contract price or <br /> contracted Hauler tipping fee minus any rebates or discounts) at the REC is$121.00 <br /> per ton in 2024.The Disposal Fee portion of the Solid Waste rates in Exhibit A will <br /> increase in proportion to increases to the Hauler Tipping Fee over the benchmark Trash <br /> Disposal Price. For example, if the tipping fee increases by 10%, the Disposal Fee <br /> potion of the Solid Waste rates will also increase by 10%. The benchmark Trash <br /> Disposal Price is dependent upon the parties'mutual understanding that all Residential <br /> Solid Waste collected under this Contract will be charged the contracted Hauler tipping <br /> fee and that the quantity of waste disposed of at the REC under this Contract will not <br /> adversely impact the limit placed on individual haulers by Ramsey County as it relates <br /> to waste not generated under this Contract.It is the parties'understanding that the REC <br /> will not charge the tonnage of such waste collected against the Hauler's maximum <br /> delivery amounts.If this understanding proves incorrect or the pricing is later increased <br /> or maximum delivery amounts are decreased or redefined,the Contract Trash Disposal <br /> Price shall be modified accordingly to reflect the increased cost of disposal. <br /> 2-."2.6.10 In the event that collection or disposal costs for any waste stream increase or <br /> decrease because of unanticipated market adjustments,the City and Hauler shall enter <br /> into good faith negotiations in order to determine if an increase or decrease to the rates <br /> is warranted;provided,however,that neither party is not obligated to consent to any <br /> such increase or decrease. <br /> A-14 <br /> MU210\313\963095.v4 <br />
