Mounds View City Council Page Three <br />Regular Meeting October il, 1993 <br />Orduno presented some examples of unfunded mandates and their effect on <br />cities and citizens. Orduno asked for Council consideration of <br />Resolution No. 4423 Opposing Federal and State Mandates and Declaring <br />October 27, 1993 as "Unfunded Mandates Day". <br />MOTIONLSECOND: Quick/Blanchard to adopt Resolution No. 4423 Opposing <br />Federal and State Mandates and Declaring October 27, 1993 as ".Unfunded <br />Mandates Day" <br />VOTE: 5 ayes 0 nays Motion Carried <br />B. Consideration of Bid Award for Construction of City Hall Expansion <br />Tim Cruikshank, Assistant to the City Administrator, reported that on <br />Wednesday, October 6, 1993, at 2:00 p.m. the bid opening for the <br />expansion of Mounds View City Hall took place in the Council Chambers. <br />Three low bids were received. Cruikshank reported that the low bidder <br />was Mikkelson-Wulff in the amount of $386,b79, the second low bidder <br />was Gladstone Construction with a bid of $394,755 and the third low <br />bidder at $404,906. The City Council can either award the bid to <br />Mikkelson-Wulff or to the second lowest bidder, Gladstone Construction. <br />Mikkelson-Wulff, on October 7, 1993, sent a letter asking to withdraw <br />their bid. <br /> <br />Mayor Linke stated that the Council had received Resolution No. 4433 <br />(with some minor changes made by the City Attorney) Accepting the Bid <br />for the City Hall Addition and Remodeling Contract. <br />Mayor Linke read the aforementioned resolution. <br />City Attorney Thomson made note that there was one non-compliant <br />bid that was not listed on Exhibit A of Resolution No. 4433. <br />Councilmember Trude asked City Attorney Thomson to explain state <br />law regarding the withdrawal by contractors on government bids. <br />City Attorney Thomson explained that the contractor does not have <br />unilateral right to withdraw the bid for 45 days. <br />A discussion followed regarding the bid bond. City Attorney Thomson. <br />explained that the City could make a claim against the bid bond which <br />would be the difference between what Mikkelson-Wulff bid and the <br />bid of the next lowest bidder. <br />Some discussion followed regarding the performance of the contractor <br />regarding construction. Orduno stated that it would not be in the <br />contractor's best interest not to perform up to par. This contractor <br />received excellent references as far as work performance and <br />C. <br />
