~unds View City Council <br />gular Meeting <br />July 22, 1991 <br />Page Four <br />Mounds View did not receive notice as a contributor to the site. <br />In looking back at the records for that time period., the City <br />shows only that it disposed of tree branches at the Oakgrove <br />Landfill. These tree branches resulted from straight-line winds. <br />Rarney indicates that we have the following options regarding <br />this situation: <br />1. Simply do nothing and wait for EPA to take action. <br />2. Join the PRP group and pay the initial $1500. <br />3. Enter into Consent Decree. If we are identified as <br />a transporter, the City would fall into Tier 4 and the <br />share of the costs would be approximately $24,000. If <br />the City were placed in Tier 3 it could cost up to <br />$48,0000 but then the City would have not have to worry <br />about any future clean up costs for this landfill. <br />• 4. Don't join the PRP Group and don't sign the Consent <br />Decree. <br />If the Council does not join the Group, and does not sign the <br />Consent Decree, City Attorney Karney would like Council direction <br />to research and receive more information regarding the City's <br />insurance policy that was in effect at that time. Karney would <br />also like to find an attorney who is an expert in this law that <br />could defend usin the evevt of litigation. <br />The Council was palled as to what each member felt should be <br />done: <br />Councilmember Rickaby - don't join the group or sign the <br />decree. Find an attorney. <br />Councilmember Blanchard - if we sign it implies the City is <br />guilty. Don't joint the group nor <br />sign the decree. <br />Councilmember Wuori - The City has a total of four trip tickets; <br />2 unreadable and 2 for brush. Don't join <br />group nor sign the decree. <br />Councilmember Quick - Communicate with other cities and possibly <br />share an attorney. Don't join group and <br />• don't sign the decree. <br />Mayor Linke - Concur with the other four. <br />
