not meet the required amount, they have thirty (30) days from <br />when the petitions are returned to the committee to do so. <br />Acting City Attorney Charlie Lefevere explained that the meeting <br />was being held tonight because of Charter requirements that state <br />a response to a petition must be made within ten (10) days of <br />receiving the petitions. He also talked about the sufficiency of <br />the petition, indicating that the petition did not meet the <br />Charter requirements and was insufficient. <br />Mayor Linke queried about what happens next. What if the <br />petition committee gets enough signatures? <br />Acting City Attorney Lefevere discussed applicable state laws and <br />how they affect the City of Mounds View's Charter. He said that <br />although Mounds View is a Charter City and the Charter allows for <br />a petition to recall a resolution via referendum, State law <br />states that only ordinances and not resolutions are subject to <br />referendum or initiative. Although the City Charter allows such <br />action, state law does not and therefore it would be illegal to <br />do so. It was also explained that the City does not need to take <br />formal action at this time but could adopt a resolution <br />prohibiting the issue to be taken to referendum. <br />Ray Weseman, 7807 Bona Road, then asked about voter registration <br />on the petitions. She was curious to know if all voters who have <br />• registered are included on the registered voter printout the City <br />received from Ramsey County. She also wanted to know when the <br />State law was passed that supersedes the City Charter. <br />Mr. Lefevere stated it is irrelevant if the State law was passed <br />before or after the City Charter. <br />Sandy Krogh, 7827 Bona Road, asked if Harstad's hardship is the <br />same issue as the charter predating state laws. <br />Mr. Lefevere could not answer the question because he did not <br />know what she was asking. <br />Councilmember Rickaby asked to review the language of the <br />petition. <br />Ray Wesemann asked if the Charter should be changed. She also <br />wanted to know what the purpose of public hearings are if the <br />input has no bearing on the decisions made by the Council. <br />Mayor Linke disagreed with Weseman stating he listens closely to <br />people when they speak and that he appreciates the input of the <br />citizens. <br />Weseman then asked what is the purpose of following through with <br />the petition process if a state law supersedes the City Charter. <br />
