Mounds View City Council February 24, 2003 <br />Regular Meeting Page 12 <br />• <br />Mayor Linke asked Mr. Ericson to have Julie Fleming Wolfe provide the information to City <br />Hall to be picked up. <br />Council Member Stigney indicated he had not heard anything on his three data practices requests <br />and asked for a status update. <br />Interim City Administrator Ericson indicated that he had no requests for data from Council <br />Member Stigney and asked him to resubmit the requests to be processed immediately. <br />Mayor Linke indicated he does not approve of the policy of having Council Members submit <br />requests in writing as they are elected to run the City and should have access to all information <br />provided it is not private. <br />City Attorney Riggs indicated that there is no exception to the data practices requirements for <br />Council Members. <br />Mayor Linke said he feels it is ludicrous to have to beg for the information he needs to do his job. <br />He then asked whether the request needs to be written or could be verbal. <br />. City Attorney Riggs indicated the City has a policy that requires the request to be in writing and <br />the statute requires that a responsible authority be designated in the City and that is the clerk <br />administrator and the clerk administrator has an obligation to follow the statute. <br />Interim City Administrator Ericson asked that Council provide their written requests to him and <br />he would research the requests as quickly as possible. <br />Mayor Linke indicated that the use of sick leave per LELS was discussed at the last meeting and <br />tabled and he would like to take it off the table for discussion. <br />MOTION/SECOND: Linke/Marty. To Take the Use of Sick Leave per LELS off the Table for <br />Discussion and Consideration. <br />Ayes - 3 Nays -1(Stigney) Motion carried. <br />Council Member Marty indicated that this would be revisited again but the individual that needs <br />it needs it right now and he feels Council should discuss this but he does not have all the <br />information and wonders whether it should be referred to a work session. <br />Mayor Linke read Resolution 5943. <br />Mayor Linke indicated he had received the information he needed to determine how to vote and <br />• that was how it would affect the LELS but it does not affect it as the City can do whatever it <br />wants to in the personnel policy.
