Mounds View City Council July 28, 2003 <br />Regular Meeting Page 13 <br />• 1 City Administrator Ulrich indicated that Kennedy & Graven had agreed to decrease the retainer <br />2 by $500.00 per month and only attend one meeting. Any subsequent meetings attended by the <br />3 City Attorney would be billed at $125.00 per hour. <br />4 <br />5 Mayor Linke indicated that doing so would save the City $6000 per year. <br />6 <br />7 Council Member Marty questioned whether mileage is charged to drive to the Council meeting. <br />8 <br />9 City Attorney Vose indicated he does not intend to charge for the mileage for this meeting or the <br />10 last one that he attended and that would be his policy and he would pass that along to Scott but <br />11 he is not sure what Scott has been doing. <br />12 <br />13 Council Member Stigney asked whether the $125.00 per hour starts at the beginning of the <br />14 meeting or the end of the meeting. <br />15 <br />16 Mr. Vose indicated that it is firm procedure to begin billing when they get in the car but not to <br />17 bill on the way home and that is fairly typical for other attorneys. <br />18 <br />19 Council Member Stigney indicated that he would like to change that practice for the City and <br />20 does not think the City should have to pay for driving time at $125.00 per hour. <br />21 <br />~2 MOTION/SECOND: Stigney/Gunn. To Waive the Reading and Approve Resolution 6059, a <br />23 Resolution Authorizing Execution of a Two-Year Legal Services Agreement with Kennedy & <br />24 Graven as Amended. <br />25 <br />26 Community Development Director Ericson indicated that the $125.00 is not in the contract and <br />27 suggested that the contract be amended to include that language under compensation for <br />28 attorneys. <br />29 <br />3o Ayes - 5 Nays - 0 Motion carried. <br />31 <br />32 D. Resolution 6064 Authorizing Bids and Specifications and Establishing a Bid <br />33 Date for the County Road H Sidewalk Project. <br />34 <br />35 Public Works Director Lee addressed Council and recommended approval of Resolution 6064 <br />36 approving the plans and specifications and establishing a bid date of August 31, 2003 to allow <br />37 time for advertising. He then indicated that the power pole relocation will be done by Xcel <br />38 Energy and the tree replacement plan will be worked on by Staff and the City Forester before it is <br />39 submitted to Council for approval and bid in the fall for replacement in the spring when nursery <br />4o stock is available. <br />41 <br />42 MOTION/SECOND: Quick/Gunn.
