Director of Public <br />Works Lee stated the County will be digging some of it out, as well as creating a pond to retain <br />water. <br />Mayor Marty asked who will pay for this. Director of Public Works Lee stated it will be paid by <br />the County Road J project. He commented it is a requirement of Rice Creek Watershed District. <br />City Attorney Riggs stated the final language in the easement would need to include a statement <br />that references the deed the City received for SYSCO Outlot A, because it had a right of reverter <br />if the City did not use it for certain purposes. He commented that Staff contacted SYSCO and <br />they did not see a problem with that language, but the easement should have one statement that <br />references any right that is granted to the County that is subject to the right of reverter on the <br />additional deed. <br />MOTION/SECOND: THOMAS/GUNN. To waive the reading and adopt Resolution 6787 <br />Authorization of the Execution of Easements Associated with the County Road J Improvement <br />Project. <br />Ayes — 4 <br />8. CONSENT AGENDA <br />Nays — 0 Motion carried. <br />Councilmember Gunn left the meeting at 9:19 p.m. <br />Councilmember Stigney asked to remove Items B, C and D. Mayor Marty asked to remove Item <br />E. <br />A. Licenses for Approval <br />W. Resolution 6779 Approving the Purchase of a Replacement Mower for the <br />Par-lis Division. <br />Division-.D-. Resolution 6783 Authorizing Step inereases for Offleer Timothy Wolf a <br />MOTION/SECOND: THOMAS/STIGNEY. To waive the reading and approve Consent Agenda <br />Item A. <br />Ayes — 3 Nays — 0 Absent — 1 (Gunn) Motion carried. <br />Councilmember Gunn returned to the meeting at 9:22 p.m. <br />
