.i <br />MEMO TO: PlanninU Couunission / lI <br />r FROM: Director of Public Works/Comuuity UnvelopmnnL �,,(>/� <br />DATE; April 6, 1983 <br />SUBJECT: EXTENSION UP PRIiLIMINAI(Y PLAT POR MILLIiR INDUSTRIAL PARK <br />On April 4, 1903, the Millers meL with the City Council to discuss <br />proceeding to final platting On four lots located in the northwest <br />corner of their properLy (se(-- aLLachcd :;1:CLCh). Lots in question <br />were approved by the City Council. for preliminary plat on March 9, <br />1901 (see attached copy of minutes). <br />The Council requested input from the City Attorney and Planning <br />Commission prior to acting on extension request at their April 11, <br />1903 meeting. Staff met with Mr. Meyers on April 6, 1903 and con- <br />cluded the following: <br />1) City Council can extend ConsidcraLion of the preliminary <br />plat of the Miller Industrial Park for good cause per <br />provisions of 42.05, Subdivision 3(1). City Attorney <br />recommends that the Planning Commission and City Council <br />extend the preliminary plat due to moritorium issues. <br />2) The Planning Commission and City Council must address impacts <br />of Chapter 42, 48, 49 and 49A as part of the preliminary <br />plat extension. <br />Staff recommends plat extension request be approved with the following <br />conditions: <br />1) Applicant meet all requirements of Chapter 40 as it relates <br />to the four lots, especially Lot 1, Block 1. <br />2) Applicant meet- all requirements of Chapter 49A (old Resolution <br />No. 983) for lots in questions. <br />3) Staff (including the City Attorney) has discussed the dcli.ne- <br />ation of the existing wetland boundaries contained in Chapter <br />48 as they relate to the Miller property. Staff recommends <br />to the Planning Commission and City Council that based on <br />data presented by the applicant that reason exists to initiate <br />reevaluation of the wetland boundary under provisions of 48.02. <br />Reevaluation by City or applicant should be completed before <br />final review and approval of the extended preliminary plat. <br />Would the Planning Commission please review and comment on request for <br />preliminary plat extension. <br />JCJ/bc <br />Attachments <br />
