MINNESOTA STATUTES <br />1982 <br />CHAPTER 112 <br />WATERSHEDS <br />112.42 MANAGERS; ORGANIZATION. APPOINTfENT OF SUCCES- <br />SORS. <br />• 0 • <br />Subd. 3. At least 30 days prior to the expiration of the term of office of the <br />first managers named by the board. the count commissioners of each of <br />affected shall meet and proceed to a Dint suacxsors rn the first mans cts If the <br />nominating petition that inmate t e rstrct ongmam rom a malon y of the <br />cities within the district or if the district is wholly within the metropolitan area. the <br />coumy commissioners shall appoint the managers from a list of persons nominated <br />jointly or severally by the townships and municipalities within the district. The <br />list shall contain at least three nominees for each positiun to be filled. It shall be <br />submitted to the affected county board at least 60 days prior to the expiration of <br />the term of office. If the list is not submitted within 60 days prior to the . <br />expiration of the term of office the county rmmissioners shall select the mana ers <br />from eli ible individuals within the district. a county comm issioners s a at <br />least 30 days before the expiration o t e term of office of any managers meet and <br />appoint the successors. If the district affects more than one count'. distribution <br />of the managers among the counties affected shall he as directed by the board. <br />Ten years after the order of establishment. upon petition of the county board of <br />commissioners or any county affected by the drstnct. the board after public <br />hearing thereon. may redistribute the managers among the counties if redistrib- <br />ution is in accordance with the policy and purposes of this chapter. No petition <br />for the redistribution of managers shall be filed with the hoard more often than <br />once in ten years. The term of office of each manager. if the number does not <br />exceed three, shall be one for a term of one year. one for a term of two years. and <br />one for a term of three years. If the managers consist of file members. one shall <br />be for a term or one year, two for a term of two years. and two for a tern of three <br />years. If the board of managers consists of mnrc than five members. the managers <br />shall be appointed so that as nearly% as fx+ssihle one-third serve terms of one year. <br />one-third serve terms of two years. and one-third sere terns of three years. If the <br />district affects more than line counrc. the hoard shall direct the distribution of the <br />one. two and three year terms among the affected countirs. Thercafter. the term <br />of office for each manager shall he for a term of three years. and until his <br />successor is appointed and qualified. If the dotnct affects more than five <br />counties. in order to prsyide for the orderly distribution of the managers. the <br />hoard may determine and idenufv the manager areas within the territun of the <br />district and srlcct the appointing count hoard of comnussmnar for each mana. <br />ger's area.
