•r • <br />■ MEMO TO: MAYOR AND CITY COUNCIL <br />1 � <br />FROM: CLERK-ADMINISTRATO <br />DATE: AUGUST 1, 1984 <br />SUBJECT: STATE GAMBLING LEGISLATION <br />Article XII of the Omnibus Tax Bill adopted by the 1984 Legislature <br />provided for the creation of a State-wide charitable Gambling <br />Control Board to regulate bingo, paddle wheels,tip boards, raffles <br />and pull tabs. In short, this new Gambling Control Board will <br />regulate all legalized forms of gambling in the State of Minnesota. <br />Cities still retain the authority to adopt more stringent regulations <br />on any form of legal gambling within its jurisdiction including <br />the authority to prohibit any form of gambling. However, if an <br />organization has a State license, it need not comply with local <br />license or permit requirements. Cities may also disapprove the <br />granting of State licenses by passing a resolution and giving <br />notice to the State Board of their desire to do so. <br />The only exemptions from State licensing requirements that would <br />apply to the City of Mounds view are for bingo events at a civic <br />celebration if not for more than 12 consecutive days in a calendar <br />year or by an organization which conducts four or fewer bingo <br />occasions in a calendar year; or raffles if the value of all <br />raffle prizes the organization awards in a calendar year does not <br />exceed $750; or raffles an organization conducts which, directly <br />or under contract to the State or political subdivision, delivers <br />health or social services and is a non-profit organization but only <br />if the prizes are not real or personal property that an individual, <br />firm, or other organization donates. All other gambling activity <br />must receive a State license. <br />The Legislation further provides that all local licenses will <br />expire on February 28, 1985 with the Gambling Control Board <br />beginning licensing March 1 of 1985. <br />police Chief Ramacher and I have discussed the new gambling law <br />in great detail and would recommend that it would be advisable <br />for the City Council to repeal Municipal Code Chapter 107 <br />entitled, "Bingo, Raffles, and Gambling Devices" effective <br />February 28, 1985 and allow the State to regulate legal forms <br />of gambling within the City of Mounds view. This recommendation <br />is being offered on the basis that it would remove the City of <br />Mounds View from an issue which has become both political and <br />controveroial in nature and is extremely difficult for Staff to <br />enforce without placing ourselves in a position of conflict with <br />charitable organizations in the community. <br />
