An employee may be demoted by the <br />appointing authority for insufficient performance of his duty, <br />for disciplinary reasons, or for other good and sufficient <br />reasoi, NCELCe ut demotion shall be in writing. <br />6.15 Dismissal. Any officer or employee subject to the <br />provisions of this chapter may by resolution be dismissed from <br />the municipal service Dy the appointing authority. Evidence of <br />the following shall be sufficient cause for dismissal: <br />(1) Incompetence or inefficiency in the performance <br />of his duties. <br />(2) Conviction of a criminal oftense or misdemeanor <br />involving moral turpitude. <br />(3) Violation of any lawful or official regulation or <br />order or failure to obey any lawful direction made and given by <br />his superior where such violation or failure to obey amounts to <br />anv act of insibordination or a breaceCtedptopresultcinroer llossineoor <br />has result or reasonably might be exp cted <br />injury to the Municipality or tc the public. <br />(4) Intcxication by reason of alconol or drugs while <br />on duty. <br />(5) physical or mentrl defect vhich, i� the judgement <br />of the appointing authority incapacitates tte emplcvee for the <br />proper performance of the duties of his position. <br />(6) The use of offensive conduct or language toward <br />the public, municipal officers or employees. <br />(7) Carelessness or negligence in the handling and <br />control of municipal officers or employees. <br />(8) Inducing or attempting to induce an officer or <br />employee of the Municipality to commit an unlawful act or to <br />act in violation of any lawful or reasonable official regulation <br />or order. <br />(9) Taking any fee, gift or other valuable thing in the <br />course of his work or in connection with it, from any person for <br />his personal use, when such fee, gift or thing is given in the <br />hope or expectation of receiving a favor or better treatment than <br />that accorded to other persons or citizens. <br />
