MEMO TO: Clerk -Administrator and City Council / <br />FROM: Director of Public Works/Community Development% Vy <br />DATE: November 14, 1985 <br />SUBJECT: PHYLLIS LEENERTS APPLICATION FOR A MINOR SUBDIVISION <br />(2609 COUNTY ROAD I) <br />Attached please find the following: <br />1. Planning Application <br />2. Letter from Landmark Surveying Inc. dated 9/26/85 <br />3. Certified survey by Landmark Surveying, Inc. dated 9/11/85 <br />and revised 9/26/85 <br />4. Planning Commission Resolution No. 148-85 <br />The subdivision is not in a flood hazard area or a wetland zone. <br />The subdivision, satisfies all City Code requirements except that <br />the neighbor who owns Lot No. 49 has a fence that is 6 inches on <br />Lot No. 48 "A". The Planning Commission resolution recommends <br />that the fence be relocated prior to approval of the minor <br />subdivision. I have contacted Mrs. Leenerts and advised her of. <br />the Planning Commission's recommendation. She stated that she <br />would get her neighbor to move the fence. <br />You could schedule a hearing on this minor subdivision prior Lo - <br />the fence being moved. If this is your desire, the courtesy <br />mailing could be .sent by November 22, 198,, w.'th the notice <br />published in the New Brighton Bulletin on November 27, 1985. The <br />hearing could then be held on December 23, 1985. -El-,is happens to <br />be the Monday before Christmas. <br />ACTION REQUESTED: Would you prefer to schedule the hearing per <br />the above timetable or wait until the fence is relocated? <br />SWT/bac <br />E <br />
