MEMO TO: Clerk -Administrator and City Council <br />FROM: Director of Public Works/Community Development // / <br />4F DATE: November 24, 1986 /U" <br />SUBJECT: EXISTING DRIVEWAY RECONSTRUCTION <br />Staff was requested to study the possibility of allowir:g existing <br />driveways to be reconstructed even if thsy are non -conforming <br />with the City Code in relation to new driveway construction. <br />I have discussed this issue with Attorney Meyers. He states that <br />it is possible to do the above. He indicated that we may want to <br />have some criteria as to when a non -conforming driveway can be <br />reconstructed to its existing size and shape. The criteria could <br />be as follows: <br />1. Was a previous permit granted that allowed the <br />non -conforming use? <br />2. How did the driveway become non -conforming? <br />3. How many years has it been non -conforming? <br />I am sure there are other criteria that we could come up with. <br />® Attorney Meyers states that the Code could be structured such <br />that new driveways meet the existing Code and thet driveway <br />reconstruction be allowed to match the existing driveway provided <br />that the criteria that we come up with is satisfied. <br />This memo is presented to ask for your direction. <br />SWT/bac <br />
