i 12/29/88 (REVISOR ] XX/MC 89-0652 <br />® 1 reasonably be expected to influence.the performance of the <br />2 official's or employee's public duties. <br />3 Subd. 3. (PRIVATE COMPENSATION FOR PUBLIC DUTIES.) No <br />4 public official or employee may solicit or accept, and no person <br />5 may offer or pay to a public official or employee, compensation <br />6 for the performance of the official's or employee's public <br />7 duties other than the compensation paid to the official or <br />8 employee by the governmental unit to which the official is <br />9 elected or appointed or by which the official or employee is <br />10 employed. This subdivision does not prohibit a public official <br />11 or employee from receiving compensation For outside employment, <br />12 provided that the outside employment does not interfere with, <br />13 influence, or compromise the official's or employee's public <br />^ 14 position. <br />15 Subd. 4. [USE OF INFORMATION.] No public official or <br />16 empj2Lee may intentionally use or disclose information gained by <br />17 reason of the official's or employee's public nosition in a way <br />18 that could result in the receipt of anything of valui by the <br />19 official or employee or any other person known to the official <br />20 or employee if the information is not public data or has not <br />21 otherwise been communicated to the public. <br />22 Subd. 5. [CONTRACTS.] (a) No public official or employee, <br />23 member of an official's or employee's immediate family, or <br />24 association in which the official or employee or immediate <br />25 family member owns or controls at least ten percent of the <br />26 outstanding equity, voting rijnts, or outstanding indebtedness <br />27 mEa enter a contract or lease with the governmental unit to <br />28 which the otficial is elected or appointed or by which the <br />29 official or employee is employed except as provided in this <br />30 subdivision. The prohibiti,n in thle subdivision does not apply <br />31 if: <br />32 (1) the value of the contract, plus the value of other <br />33 contracts awarded to the same contractor by the governmental <br />34 unit during the preceding 12 months, does not exceed $1,000_ <br />35 (2) the contract is available on the.same terms to the <br />36 general public or to a broad class of potential contractors; or <br />19 <br />
