y The use of the machines and programs will be under the Customer's exclusive management and control. The Customer will have sol,: responsibility for the selection of the configuration and any changes therein and for assuring the proper use, management and supervision of the machines and programs (whether or not MAYS has assisted in Lhe preparation of or has supplied such Programs), audit controls, operating methods and office procedures, for establishing the necessary control over access to data, and for establishing all proper check points and procedures necessary for the Customer's intended use of the machine and the security of the data stored therein. MASYS or MASYS Service Representatives will not be liable for personal injury or property damage except personal injury or property damage caused by MASYS negligence. MASYS shall in no event have obligations or liabilities for consequential damae« even if HASYS has been advised of the possibility of such damage. The Customer agrees that MASYS will not be liable for any damages caused by Customer's failure to fulfill any Customer responsibilities as set forth above or for any lost profits or for any claim or demand by any other party. Tha Customer further agrees that HASYS liability hereunder for damages, regardless of the form of action, shall not exceed the total amounts paid under this Agreement by the Customer and this shall be the Customer's exclusive remedy. 12. ENFORS SYSTEH SUPPORT MaSys Cor—ration will provide system support services to resolve any problems that occur at the ENFORS site. MaSys will provide assistance both in problem identifi- cation and problem resolution. Specifically, the following items will be included: 12.1 HARDTAP.E - MaSys Corporation will provide hardware support according to the previous paragraphs. 12.2 TEXAS INSTRUMENTS, LICENSED SOFTWARE - MaSys Corporation will provide a user license for the Texas Instruments software listed on page 1. Wya Corporation will provide new releases for the customer that are under license by MaSys. 12.3 COMHUNICATIONS - MaSys will assist the customer with :dencification of any problems related to communication facilities provided for operation of the ENFORS system. If MaSys Corporation determines that the problem is related to the state network, MaSys will take appropriate actions to resolve the problem, if the user so desires. 12.4 OPERATOR USAGE - MaSys will provide telephone support for many operator - related problems, including those with back-up procedures, system start- up, ENFORS operation, or other operator related questions. If additional operator training is requf_ed, MaSys will provide this training at the Wys location. 12.5 TEXAS INSTRUMENT aOFTWARE UPDATE - MaSys Corporation will, provide any updates to Texas Instruments software required to operate the ENFORS system. MaSys will determine the impact of the update prior to installa- tior. including any modified operator procedures. PAGE 5 of 6
