TO: I4AYOR AND CITY COUNCI <br />FROM: CLERY.-ADMINISTRATO <br />JULY 21, 1989 <br />SUBJECT: MUNICIPAL CODE CHAPTER 108 ENTITLED, "PUBLIC DANCE <br />HALLS" <br />As you may recall from reading my 1989 Legislative Summary <br />Report, the Minnesota Legislature rescinded all state laws <br />regulating the operation of public dance halls in the <br />state. The action by the Legislature did not, however, <br />prohibit cities from regulating public dance halls. Chapter <br />108 of the Municipal Code entitled, "Public Dance Halls" is <br />the City's regulating =ode for Public Dance Halls which <br />is limited to the Bel -Rae Ballroom. <br />After discussing this issue with Police Chief Ramacher, it <br />is our conclusion and recommendation that the regulation of <br />public dance halls by the City of Mounds View is unnecessary <br />in that the rescision of this Chapter of the Municipal Code <br />would be appropriate. This recommendation is based on the <br />fact that the City has not had a problem with public dance <br />hall operation and that the current liability issues faced <br />by public dance hall operators are requiring that they <br />operate in a manner consistent with, or more restrictive <br />than, our requirements to protect themselves. For that <br />reason we feel that the regulation of public dance halls by <br />the City does not protect the health, safety and welfare of <br />our residents beyond that which would be available from <br />public dance halls operating without these licenses or <br />regulations. <br />Your direction in this matter would be appreciated. <br />DFP/MJS <br />
