t <br />INFORMATIONAL <br />MEMORANDUM <br />Memo To :;nfdyor and City Council Members <br />From :Ric Minetor, City Engineer/Director of Public Works <br />Date :August 16, 1989 <br />Subject :Sewer Problem and LawsuiL <br />5259 Greenfield Ave. - Paul Johnson <br />Mr. Johnson has filed a lawsuit against the City regarding an <br />alleged sanitary sewer backup that damaged his house. This bas <br />been discussed at council and our insurance company has reviewed <br />the claim and denied it. This memo is simply to notify you of the <br />impending lawsuit. Attached are previous memos regarding this <br />situation as well as a copy of the sewer main map in this area. <br />At various times Mr. Johnson has questioned whether the force <br />main or the car wash could be responsible for his problem. As you <br />will note, since the car wash is serviced by the line in O'Connel <br />Drive and this flows to the force main, the car wash could not be <br />directly contributory to the problem. The force main dumps into <br />the man hole at the end of Greenfield; and the Johnson residence <br />is midway in the block. If the force main were the culprit, the <br />neighbors would also have had problems. Please contact me if you <br />have any questions or concerns. <br />
