MEMO TO: <br />Don <br />Brager, <br />Finance <br />Director <br />iq <br />7 <br />FROM: <br />Mike <br />Ulrich, <br />Public <br />Works Foreman <br />DATE: February 15, 1989 <br />SUBJECT: INSURANCE CLAIM AT 5259 GREENFIELD AVENUE <br />The following is in reference to Mr. and Mrs. Johnson's complaint <br />of damages sustained by sewer back-up. We received a call on <br />December 7, 1988, at approximately 7:00 P.M. informing us that <br />the Johnson's sewer had backed up. .Wally Mortenson responded to <br />the call; he checked our main line which was clear and also talked <br />to the homeowners and told them that we did not have an <br />obstruction in our lice. <br />On December 15 at aporoximately 6:30 a.m. dispatch had informed me <br />of another sewer back uo at the same residence, 5259 Greenfield <br />Avenue, in which we responded to immediately. At approximately <br />6:45 a.m. Wally responded to the residence and checked our lines <br />which were again clean ana running freely. A short time after <br />Wally had spoken to the resident, I sent Gary Kardell to the <br />location so that we would have further testimony as to what the <br />conditions of the back-up actually were at that residence. ' C <br />Approximately one half-hour later I was asked to return to the <br />location to try to explain further the City's position on what had <br />happened and reaffirm that we did not have a blockage in our <br />line. Fowever, Mr. and Mrs. Johnson did not believe our <br />explanation. Gary and myself did view the back-up in their <br />basement; they had approximately 3/4" of what appeared to be <br />sewage. It was mainly clear water, some toilet tissue, etc. We <br />did express our sympathy, but under no means did we ever implicate <br />the City of Mounds View being at fault for the back-up. <br />In an effort, to substantiate our position we ran the jet rodder <br />down our main and once again found no obstruction. After our <br />rodder had passed the service at 5259 Greenfield Avenue their <br />water level did cecrease in the basement. We maintained that they <br />had some type of Obstruction at the end of their service and we <br />essentially cleaned t^a end of their service with the power of the <br />jet nozzle when we =_nt bv. We then had the line talevised with a <br />report documenting ;w obstructions and photographs were taken of <br />the resident's se:'rice snowing deposits of poss;ole grease or <br />other deposits of sL:dce, etc., at the end of their service. <br />Since that day I have had numerous conversations with Mr. Johnson <br />emphasizing our exolanation of the situation.. Once again, <br />informing him that is was our belief that we did ;not cause the <br />back-up. He viewed the pictures taken of his s>-r•rice and the line <br />and also read the :e - from <br />1 5cr .,e te;evision crew.
