I I <br />MEMO TO: MAYOR AND CITY COUNCIL <br />FROM: CLERK -ADMINISTRATOR <br />DATE: APRIL 8, 1988 <br />SUBJECT: PUBLIC WORKS GARA:,- FACILITY, USE POLICY <br />During the recent City Council tour of the Public Works <br />garage addition Public Works Foreman Mike Ulrich raised the <br />issue of allowing City employees to use the wash bay portion <br />of the Public Works garage facility for minor maintenance <br />and cleaning of their personal vehicles. In response to <br />what appeared to be a general consensus among the Council - <br />members that this would be acceptable, I developed a policy <br />for use of the Public Works garage facility using standards <br />from neighboring cities, including the City of New <br />Brighton. Attached fo, your information is a copy of the <br />policy I developed. <br />After developing the policy I met with the Department Heads <br />and reviewed it with them and received some rather strong <br />opposition to the limitation of the use of the facility to <br />employees only. Certain members of the management team felt <br />that an employee's spouse and dependent children should be <br />allowed to be in the facility in the presence of the <br />employee and that vehicles registered to the employee, <br />spouse and dependent children should also be allowed to be <br />cleaned or maintained in the facility. As a result of this <br />discussion, I contacted our insurance agent to determine the <br />advisability of allowing an employee's spouse and children <br />to work in the PW is Works garage facility. Our insurance <br />agent has adv'^ad us that the company underwriter and risk <br />manager both :eel that the City should not allow employees <br />or other individuals to work on personal vehicles or other <br />equipment in our garage facilities. They take this position <br />on the basis that it is their job as well as that of the <br />City's to limit our liability exposure thus developing a <br />positive experience rating which would have a positive <br />effect upon our insurance premiums. Our agent also advised <br />me tnat our employees am; vL;ic,: he nnvoraA _ <br />for injuries sustained while working in the Public Works <br />garage facility after hours should the injury result from <br />the negligence of the City. If the injury results from the <br />negligence of the employee or other individual, our <br />insurance would not cover us but we could still be found to <br />be liable for damages should a lawsuit be filed against the <br />City. <br />As a result of the discussions I had with the Department <br />Heads and our insurance agent, I have c,)me to the conclusion <br />that the City has three options before it with respect to <br />allowing the use of the Public Works garage facility after <br />hours. <br />
