9.1A2 Whether the individual may refuse or is legally required to supply <br /> the requested data; <br /> 9.1A3 Any known consequences from supplying or refusing to supply the <br /> information, and <br /> 9.1A4 The identity of other persons or entities authorized by state or federal <br /> law to receive the data. <br /> 9.113 A Tennessen warning is not required when: <br /> 9.1131 An individual is requested to supply investigative data to a law <br /> enforcement officer; <br /> 9.1B2 The data subject is not an individual (e.g., the data subject is a <br /> corporation or partnership); <br /> 9.1133 The data subject offers information that has not been requested by <br /> the City; <br /> 9.1B4 The information requested from the individual is about someone <br /> else; <br /> 9.1135 The City receives information about the subject from someone else; <br /> or <br /> 9.1B6 The information requested from the subject is classified as public <br /> data. <br /> 9.1C A Tennessen warning may be on a separate form (Exhibit 9) or may be <br /> incorporated into the form which requests the private or confidential data (using <br /> language in Exhibit 8). <br /> 9.11) Collection of Data on Individuals through the Use of the City's <br /> Computer System. When an individual gains access to government information <br /> or services through the City's computer system, the City may create, collect, or <br /> maintain electronic access data or use its computer to install a cookie on an <br /> individual's computer. The City must inform individuals gaining access to the <br /> City's computer system of the creation, collection, or maintenance of electronic <br /> access data or the City's use of cookies before requiring the individual to provide <br /> any data about the individual to the City. As part of that notice, the City must <br /> inform the individual how the data will be used and disseminated. Notwithstanding <br /> an individuals' refusal to accept a cookie on its computer, the City must allow the <br /> individual to gain access to data or information,transfer data or information, or use <br /> government services by means of the City's computer system. <br /> 10 <br />
