To Waive the Second Reading and Adopt Ordinance <br />1043, Amending the Zoning Code Relating to Public Hearing Processes. <br /> <br />ROLL CALL: Clark/Gunn/Meehlhause/Smith/Lindstrom. <br /> <br /> Ayes – 5 Nays – 0 Motion carried. <br /> <br />B. PUBLIC HEARING: Second Reading and Approval of Ordinance 1045, <br />Amending Mounds View City Code 160.088 related to Accessory Dwelling <br />Units ROLL CALL VOTE. <br /> <br />Evan Monson, Stantec, requested the Council hold the second hearing and approve Ordinance <br />1045 relating to accessory dwellings. He explained the Council reviewed this matter at a <br />worksession meeting and the Planning Commission reviewed this matter at their meeting on July <br />2. He summarized the proposed changes noting he had spoken to public works about shared <br />water/sewer connections being privately maintained. He stated if the Council supported the shared <br />water/sewer connection language, he would recommend the Council table action on this item to <br />allow staff to revise the language further. <br /> <br />Council Member Smith reviewed the definition of a short-term rental and asked if the City would <br />allow an ADU to be rented for two months. Mr. Monson reported this would be allowed. He stated <br />the Council could further review the short-term rental language within City Code. <br /> <br />Mayor Lindstrom explained the 30-day requirement was put in place to curb weekend or week- <br />long rentals. He stated he did not believe rentals more than 31 days were a concern in the City. He <br />understood that snowbirds rented out their homes during the winter months and this was allowed <br />per City Code. He questioned if the City has identified a specific type of housing that was not <br />allowed in specific locations, would this open the City up for liability. City Attorney Riggs advised <br />this was a distinct and unique use from an overall use in the community. He indicated the City <br />Council could talk about putting a robust rental licensing program in place. <br /> <br />City Administrator Zikmund reported the recommendation from staff was to table action on this <br />item and staff could bring back a short-term rental definition for further discussion. <br /> <br />City Attorney Riggs recommended the Council open and continue the public hearing for this item. <br /> <br />Council Member Clark inquired if a rental license would be required if a family member was living <br />in the ADU. City Administrator Zikmund suggested the City Council discuss this topic further at <br />an upcoming worksession meeting. <br /> <br />Mayor Lindstrom opened the public hearing at 6:16 p.m. <br /> <br />Rebecca Scholl, 2467 Hillview Road, asked if a snowbird would be allowed to build an ADU and <br />could then rent both units during the winter months. She inquired if sewer lines would have to be <br />updated at the time an ADU was constructed. She reported she used to manage rentals in Mounds
