depending upon the extent of the redevelopment of the property <br /> outside the four walls of the building; and (iii) it will work <br /> diligently work to meet or exceed any storm water requirement of <br /> the Watershed District. <br /> As identified on Exhibit D, a pond and requisite storm sewer will <br /> be installed to deal with storm water from the Property. The pond <br /> will be approximately 18,000 square feet, but the location of the <br /> pond may change depending on the development of the New <br /> Market Property. Additionally, over 34,600 square feet of <br /> pervious surface will be added in the middle of Apache Plaza <br /> (around Apache Plaza and in the parking lot) as landscaping. <br /> A topographical survey of the existing condition of the property is <br /> attached hereto as Exhibit D-1. <br /> The Applicant will commence construction of all storm water <br /> drainage improvements no later than August 31, 2003. Upon the <br /> issuance of a building permit, the Applicant will provide <br /> reasonable security to the City for the completion of the storm <br /> water drainage improvements (e.g., bonding). <br /> There is no as-built grading and drainage plan for the site. <br /> J. Community Space. Approximately 7,000 square feet of Apache <br /> Plaza may be renovated into a community space. The general <br /> parameters and the nature of the community space will most likely <br /> be determined by a task force that will include.members of the City <br /> Council, Planning Commission and the Applicant. The nature of <br /> the community space will not be defined until after approval of the <br /> Final Development and the execution of the PUD Agreement. <br /> iv. Performance Standards — Fallback Plan <br /> a. Internal Improvements. With respect to the internal improvements <br /> in the Fallback Plan, the Applicant will discuss and negotiate with <br /> each individual tenant a list of improvements that may be made <br /> within a certain parameter, in addition to the allowance for tenant <br /> finishes. The list of basic Specifications may include parameters <br /> for the floor, lighting, electric, sprinkler, restrooms, and other <br /> miscellaneous items, and will be similar to the Fallback Plan <br /> Baseline. Tenant finishes required for the use will be completed. <br /> An example of the list of internal Specifications is discussed with <br /> each individual tenant. An example of the list of internal <br /> Specifications that will be used for the subject Property is attached <br /> hereto as Exhibit N. <br /> 10 <br />
