S k d fla-\t 127 <br /> amateur radio tower/dish antenna permit and a Building Permit shall be <br /> �.- issued upon the execution of a amateur radio tower/dish antenna <br /> Agreement. The terms of the amateur radio tower/dish antenna agreement <br /> shall include the following: <br /> (a) A list of the conditions of approval to the amateur radio tower/dish <br /> antenna Permit: <br /> (b) A statement indicating that failure to comply with the conditions of <br /> approval shall result in the removal of the tower/antenna structure. <br /> (c) A statement indicating that the expenses incurred by the City to enforce <br /> the provisions of the amateur radio tower/dish antenna Agreement shall be <br /> reimbursed by the applicant. <br /> (d) A statement which requires the applicant to utilize the procedures <br /> established by the FCC to resolve any complaints received relating to <br /> interference allegedly caused by the amateur radio tower/dish antenna. <br /> (e) A statement indicating that the amateur radio tower/dish antenna permit <br /> shall be valid during the term of the amateur radio tower/dish antenna <br /> agreement and only while the applicant resides on the property. <br /> (f) An application fee in an amount prescribed from time to time by City <br /> Council resolution on file with the City Manager. <br /> (4) Review and Revocation. The City Planner shall inspect the property at least <br /> annually for compliance with the provisions of the amateur radio tower/dish <br /> antenna agreement. If the permittee is not in compliance with the terms of the <br /> Agreement, a hearing shall be scheduled before the City Council for the <br /> purpose of determining whether to terminate the Agreement. The.hearing <br /> shall be preceded by ten (10) days mailed notice to occupants of property <br /> within 350 feet of the lot on which the amateur radio tower/dish antenna is <br /> located. <br /> (5) Removal of amateur radio tower/dish antenna. Use of the amateur radio <br /> tower/dish antenna shall be discontinued upon termination of the amateur <br /> radio tower/dish antenna Agreement and prior to the transfer of title for the <br /> property on which the tower is located. The property owner shall, at its cost, <br /> reduce the height of the,antenna to that allowed without a permit and shall <br /> disassemble and remove the amateur radio tower/dish antenna within thirty <br /> (3)0) days of termination of the amateur radio tower/dish antenna Agreement, <br /> or the purchaser of the property shall apply for a new permit. <br /> (D) Broadcast Tower Permit. Broadcast towers are allowed irr'the (T) Tower District <br /> only and must obtain a Conditional Use Permit pursuant to Section 202.072. <br /> (E) Wireless Telecommunication Tower/Antenna Permit. <br /> 200- 138 <br />
