City of Saint Anthony Housing Maintenance Ordinance <br /> Draft Number 3 -- March 23, 1992 <br /> Page Number 14 <br /> 1 No person shall occupy nor permit or let to be occupied any dwelling or dwelling unit for <br /> 2 the purpose of living therein, which does not comply with the following requirements: <br /> 3 <br /> 4 PERMISSIBLE OCCUPANCY OF DWELLING UNIT. With the exception of owners <br /> 5 occupying a respective dwelling unit prior to 1940, the maximum permissible occupancy of <br /> 6 any dwelling unit shall be determined by reference to the current Minnesota Uniform <br /> 7 Building Codes. <br /> 8 <br /> 9 ONE FAMILY PER DWELLING UNIT. Not more than one family, except for temporary <br /> 10 guests, shall occupy a dwelling unit. <br /> 11 <br /> 12 MINIMUM CEILING HEIGHT. In order to qualify as habitable, rooms shall have a clear <br /> 13 ceiling height of not less than seven feet, six inches, except that in attics or top-half stories <br /> 14 used for sleeping, study, or similar activities, the ceiling height shall be not less than seven <br /> 15 feet six inches over at least one-half of the floor area. In calculating the floor area of such <br /> 16 rooms in attics or top-half stories, only those portions of the floor area of the room having <br /> 17 a clear ceiling height of five feet or more may be included: Open beam ceilings shall have <br /> 18 a clear ceiling height of seven feet. <br /> 19 <br /> 20 ACCESS THROUGH SLEEPING ROOMS AND BATHROOMS. No dwelling unit build <br /> 21 after 1940 and containing two or more sleeping rooms shall have a room arrangement such <br /> 22 that access to a bathroom or water closet compartment intended for use by occupants of <br /> 23 more than one sleeping room can be gained only by going through another sleeping room, <br /> 24 nor shall the room arrangement be such that access to a sleeping room can be gained only <br /> 25 be going though another sleeping room. A bathroom or water closet compartment shall not <br /> 26 be used as the only passageway to any habitable room, hall, basement or cellar or to the <br /> 27 exterior of any dwelling unit. <br />
