3.333 (18) Occupancy: The purpose for-which a building, or part thereof, is used or <br /> intended to be used. <br /> • 3.333(19) Occupant: Any person(including owner or operator)inhabiting or occupying and <br /> utilizing a building or portion thereof. <br /> 3.333(20) Occupied: For dwelling units,occupied areas will include those areas designated <br /> and utilized as habitable space, as well as non-habitable spaces which are easily <br /> accessible and normally utilized by the occupants. For non-residential facilities, <br /> occupied areas will include all areas utilized in the operation of whatever use <br /> occupies the building. <br /> 3.333(21) Operato r: The owner or his agent who has charge,care,control,or management <br /> of a building, or part thereof, in which dwelling units, rooming units, or <br /> commercial or industrial facilities are let. <br /> 3.333 (22) Owner: Any person, firm, or corporation who, alone,jointly, or severally with <br /> others, shall be in actual possession of, or have charge, care or control of, any <br /> building or portion thereof within the City as owner, employee, or agent of the <br /> owner, or as trustee or guardian of the estate or person of the title holder. Any <br /> such person representing the actual owner shall be bound to comply with the <br /> provisions of this Code to the same extent as the owner. <br /> 3.333(23) Permissible Occupancy: The maximum number of persons permitted to reside in <br /> a dwelling unit or rooming unit. <br /> 3.333(24) Plumbint: All of the following supplied facilities and equipment: gas pipes, gas <br /> • burning equipment,water pipes,steam pipes,garbage disposal units,waste pipes, <br /> water closets, sinks, installed dishwashers, lavatories, bathtubs, shower baths, <br /> installed clothes washing machines, catch basins, drains, vents, and any other <br /> similar fixtures and the installation thereof,together with all connections to water, <br /> sewer, and gas lines. <br /> 3.333 (25) Premises: A platted lot or part thereof or unplatted parcel of land, either <br /> occupied or unoccupied by any dwelling or nondwelling structure, including such <br /> building, accessory structure, or other structure thereon. <br /> 3.333 (26) Proper Connection to an Approved Sewer System: A functioning sewer <br /> connection free from defects, leaks, or obstructions with sufficient capacity to <br /> drain all fixtures or appliances which feed into it. The sewer system (be it <br /> municipal or private)must be capable of disposing of sewage in a safe sanitary, <br /> and adequate manner. <br /> 3.333 (27) Proper Connection to an Approved Water System A functioning plumbing <br /> connection free from defects,leaks,or obstructions providing an uncontaminated, <br /> controllable flow of cold or heated water. <br /> 3.333 (28) Public Areas: In a non-residential facility, those areas which are normally <br /> occupied by the general public or non-employees, or those which would be <br /> accessible to the public under normal cir cumstances. <br /> 3.333 (29) Reasonable Care.
