-4- <br /> RESOLUTION 82-023 <br /> A RESOLUTION ACCEPTING BID FOR <br /> • RECONSTRUCTION/REPLACEMENT OF THE <br /> ST. ANTHONY BOULEVARD BRIDGE <br /> Motion carried unanimously. <br /> Walter Chesky , 2912 Hilldale, was present to ask questions about the <br /> proposed fence ordinance which was being given its third reading by <br /> the Council. He said he was the first homeowner on Hilldale and ' this <br /> is the first time he has had a problem with his neighbors maintaining <br /> their side of the fence which is built away from their property line. . <br /> He asked how people are to know whether their existing fences are on <br /> their own or their neighbor's land. ,Mr. Soth told Mr. Chesky it is <br /> the property .owner ' s responsibility to prove the fence is sited within <br /> his own property lines and, if an existing fence is set back from the <br /> property line , it should be that owner 's responsibility to keep the <br /> stretch of land between his and his neighbor' s land maintained. <br /> Councilman Enrooth added that Mr. Chesky must be willing to permit <br /> the neighbor to trespass on his land to cut the weeds . Mr. Childs <br /> said he would send someone out to the Chesky property to see if the <br /> City can be of some help in this difficulty. <br /> Mr. Soth told Councilman Marks he does not believe a permit would be <br /> necessary for replacing a fence which has deteriorated, as long as <br /> the fence is sited in the same location. Replacing a wire fence <br /> should not constitute an alteration which would require a permit <br /> • under -the new ordinance.. The difference between a fence which poses <br /> a safety hazard and one which is only an eyesore was also explored. <br /> Motion by Councilman Marks and seconded by Councilman Letourneau to <br /> approve the third reading and adopt the fence ordinance as\ submitted. <br /> ORDINANCE 1982-003 <br /> AN ORDINANCE RELATING TO FENCES ; REQUIRING <br /> BUILDING PERMITS ; REGULATING LOCATIONS ; <br /> PROHIBITING CERTAIN FENCES; P21ENDING THE <br /> 19.73 CODE OF ORDINANCES BY ADDING A SECTION <br /> Motion carried unanimously. <br /> Mr. Childs read the bids submitted for the City 's umbrella liability <br /> and errors ' omissions coverage and recommended, the low bids be accepted. <br /> Motion by Councilman Marks and seconded by Councilman Letourneau to <br /> accept the bid of Nordstrom (,Integrity Insurance Co. ) in the amount <br /> of $4 , 000 for the City ' s umbrella liability insurance . . <br /> Motion carried unanimously . <br /> Motion 'by Councilman Marks and seconded by Councilman Enrooth to accept <br /> the bid from Midwest Area, Inc. (Western World/St. Paul Surplus Lines <br /> • Co. ) in the amount of $2 ,085 . 75 for the City ' s errors/omissions <br /> coverage. <br /> Motion carried unanimously. <br />
