-4- <br /> Motion by Councilman Marks and seconded by Mayor Sundland toapprove <br /> the second reading; waive the third reading; and adopt Ordinance <br /> 1982-005 . <br /> • ORDINANCE 1982-005 <br /> AN ORDINANCE RELATING TO LAND USE, <br /> PROVIDING FOR BODY TANNING SALONS AS A <br /> CONDITIONALLY PERMITTED USE <br /> Voting on the motion : <br /> Aye : Marks , Sundland, Letourneau, and Enrooth. <br /> Nay : Ranallo. <br /> Motion carried. <br /> Motion by Mayor Sundland and seconded by Councilman Marks to grant a <br /> Conditional Use Permit under City Ordinance 1982-005 to Keith Grewe , <br /> 1001 Orchard Avenue , which will allow the operation of a Tan Me, <br /> Inc. body tanning salon in a commercial district, specifically the <br /> lower level of the Apache Plaza Shopping Center, subject to : <br /> (1) An annual review by staff of. the operation which would be <br /> reported back to the Council . <br /> (2) No violations of any law or ordinance with alleged violations <br /> brought to the Council for possible revocation of the Conditional <br /> Use Permit. <br /> The Council finds , as did the Planning Commission , that;. <br /> (=a) no one appeared before the Commission to object to the permit; <br /> (b) the proposed service would appear to fit in well with other types <br /> of services offered at Apache; and <br /> (c) there have been no reports related to problems connected with . or <br /> complaints about similar types of operations in other municipalities . <br /> Voting on the motion: <br /> Aye : Sundland, Marks , .Letourneau, and Enrooth. <br /> Nay : Ranallo. <br /> Motion carried. <br /> At 8 : 50 P.M. ; the Mayor opened the public hearing on the reallocation <br /> of the two remaining Community Development Block Grant Year V funded <br /> projects to Year VI , .as per the June 3rd memorandum from the Administra- <br /> tive Assistant. Mr: Berg explained that the $22 , 823 designated for <br /> the provision of sidewalks along side of 37th Avenue N.E. could not <br /> be used until that roadway is rebuilt by Ramsey County and the Public <br /> Works Department would probably expend the $7 , 000 dedicated to the <br /> removal of the curbing at sidewalks along St. Anthony Boulevard when <br /> they do that work this fall .
