As recommended by the Planning Commission, the Council <br /> 3 conditioned the plat approval on: <br /> 4 1. Detailed plans from the developer to include (a) screening rather than <br /> 5 berming along the railroad tracks, (b) provision of no less than a 15 <br /> 6 foot sideyard setback as well as trees and shrubbery. along the west <br /> 7 property line adjacent to Building #1, and (c) location identification <br /> 8 of the two ponding areas proposed by the developer in the Final Plat. <br /> 9 2. Drainage subject to City engineering approval. <br /> 10 3. Final Plat approval depending on a signed Redevelopment Agreement <br /> 11 with Evergreen Development. <br /> 12 In approving the Preliminary Plat, the Council acknowledges the <br /> 13 develo er's offer to negotiate a shared cost access easement over the <br /> 14a� � closest to the railroad tracks for future development of Lot 5, <br /> 15 V1lella Subdivision. <br /> 16 Motion carried unanimously. <br /> 17 Vote on Minnesota Scientific Permit Extension Delayed for Councilmember <br /> 18 Marks' Arrival <br /> 19 The Council had imposed an October 31st deadline on the company's use <br /> 20 of a mobile trailer for an office during their August 25, 1987 meeting <br /> 21 and the Planning Commission had held a public hearing on the extension <br /> 22 of that permit during their October 19th meeting. <br /> 23 Commissioner Brownell explained that the unanimous Commission recommen- <br /> 24 dation that the Council grant the requested extension had been predi- <br /> 25 cated on the Minnesota Scientific President, Bruce LeVahn's testimony <br /> 26 that it had taken 6 months to negotiate the lease with the Donatelle <br /> 27 Company for new office facilities in one of their buildings in New <br /> 28 Brighton which would not be ready for occupancy until sometime in March. <br /> 29 The Commission representative assured Mayor Sundland that the Commission <br /> 30 recommendation had also anticipated that the mobile trailer facility <br /> 31 would be removed whenever the firm vacated its St. Anthony location. <br /> 32. He also indicated all the rest of the conditions the Council had imposed <br /> 33 on the permit in 1987 would. remain in force until that time. <br /> 34 The Council agenda packet included copies of the City Manager's October <br /> .35 14th memorandum to the Commissioners, pertinent 1987 Commission and <br /> . 36 Council minutes, and the September 19, 1988 - letter from Michael <br /> 37 Donatelle of Donatelle Properties requesting the deadline extension.. <br /> 38 Councilmember Enrooth noted that the fears expressed by both the <br /> 39 Commission and Councilmembers in 1987 that the. trailer would not be gone <br /> 40 even by December had certainly come true. Councilmember Makowske <br /> 41 indicated she continued to oppose an add-on to this property for which <br /> 42 she perceived Minnesota Scientific was deriving value which they <br />
