He indicated the average of the two adjacent lots is <br /> 4 thirty-three feet, therefore, the property should have this depth at a minimum. <br /> 5 <br /> 6 Mr. Jenson reported that the petitioner is proposing to extend two and a half feet out from the <br /> 7 current front of his home, which would leave a thirty and a half foot front yard setback. He <br /> 8 indicated this depth would be close to the east neighbor's front yard setback, which is thirty feet. <br /> 9 <br /> 10 Mr. Jenson added that Mr. Rabine has explained to Staff that the proposed front entry would <br /> 11 have four posts, so you would be able to "see through it." <br /> 12 <br /> 13 Mr. Jenson reported that the Planning Commission recommends approving the petition for <br /> 14 variance by Mr. Rabine, 2800 34th Avenue Northeast. <br /> 15 <br /> 16 Motion by Councilmember Faust, seconded by Councilmember Stille, to Adopt Resolution 04- <br /> 17 054 Approving a Front Yard Setback Variance for Property Addressed 2800 34th Avenue <br /> 18 Northeast. <br /> 19 <br /> 20 Discussion: <br /> 21 Councilmember Stille inquired as to whether there was neighborhood opposition to the petition <br /> 22 for variance. Mr. Jenson assured him that, as to his knowledge, there was none. <br /> 23 <br /> 24 Councilmember Faust questioned the front entry and the overhead cover that would be provided. <br /> 25 Mr. Jenson indicated that the roofline hangs over providing the overhead cover. There was <br /> 26 discussion as to how far the roofline would reach, and what would remain uncovered. <br /> 27 <br /> 28 Motion carried unanimously. <br /> 29 <br /> 30 C. Resolution 04-055: Denying 2250 St. Anthony Boulevard Sunset Memorial Park <br /> 31 Monument Sign Variance for(a) Second Sign and (b) for Sign Height <br /> 32 Jan Jenson reported that on July 20, 2004, the public hearing for the sign variances associated <br /> 33 with a second monument sign proposed for Sunset Memorial Park, 2250 St. Anthony Boulevard, <br /> 34 was held. He indicated the applicant requested this case be brought forward swiftly, therefore, no <br /> 35 concept review was held. <br /> 36 <br /> 37 Mr. Jenson reviewed for the Council that Sunset Memorial Park is requesting two sign variances, <br /> 38 one for a ground, or monument, sign proposed for the intersection of St. Anthony Boulevard and <br /> 39 one on New Brighton Boulevard. He indicated that on behalf of Sunset Memorial Park, the <br /> 40 Lawrence Sign Company has been in contact with the City on this request. <br /> 41 <br /> 42 Mr. Jenson noted the City's zoning map for the property shows it as R-1 Single Family, adding, <br /> 43 however, according to the city code, cemeteries fall under Recreational Open Space (ROS). <br /> 44 He added for all intensive purposes, the City will consider this request under the ROS district, <br /> 45 indicating that the cemetery is considered a legal non-conforming use in the ROS. <br /> 46 <br />
