Approval of Proposal for Engineering Services for Fuel Tank Replacement. 3 Mornson reported.that in 1997 the Federal Environmental Protection Agency adopted regulations 4 governing underground storage tanks. All ftiel tanks installed before December 1998 that do not 5 meet the standards must be removed. One such tank which was located by the old Community 6 Center has been removed. There-are existing fuel tanks near the Public Works building which 7 need to be removed. 8 Mornson noted the funds for this project are in the City budget. The Minnesota Petro Fund will 9 reimburse 90% of the cost of the tank removal back to the City provided a contractor who is on 10 the Pollution Control Agency list is utilized. Staff is recommending that Nova Environmental I I Services, Inc. be hired for this project. 12 Motion by Marks, second by Faust to retain Nova Environmental Services, Inc. in the amount of 13 $6,284.00 for the fuel tank replacement at the Public Works building site. 14 Motion carried unanimously 15 B. Ordinance 1998-007, re: Cable TV Franchise Tenn (Waive First 2 Readings and Adopt). 16 Mayor Ranallo noted that.City policy is to have two readings and then adoption of any ordinance 17 change. This situation is unique in that the City did approve an extension of this ordinance 2-3 18 months ago which will expire on April 20, 1998. He explained that Meredith Cable is in the 19 process of selling the cable company and the company was to be purchased by U.S. West. U.S. 20 West was not allowed to purchase the cable company as it would infringe on the open policy 21 regarding cable. U.S. West has since decided to split it's company and include Media One who 22 would then purchase the cable company. He requested the Council approve this ordinance 23 amendment to allow the law firm time to continue to make progress on this issue. 24 Motion by Marks, second by Thuesen to waive the first two readings and adopt Ordinance 1998- 25 007, an ordinance amending Cable Franchise Ordinance 1982-009, Article II., Section 4, 26 Franchise Term. 27 Motion carried unanimously. 28 C. Resolution 98-037, re: Wetland Conservation Act. 29 Morrison reported this resolution will designate the City of St. Anthony as the administering 30 agency of the Wetland Conservation Act for the southwest area of the community. - 31 Motion by Marks, second by Faust to approve Resolution 98-037, adopting the permanent rules 32 of the Wetland Conservation Act. 33 Motion carried unanimousLy. 34
