-3- <br /> The Council members were reminded .of the November 18th Association of <br /> Metropolitan Municipalities membership meeting and noted the confirma- <br /> tion of the Mayor to the Federal Surplus Property Advisory Committee . <br /> Mr. Childs distributed .copies of the Fourth Judicial District Court <br /> Order dated October 22nd which denied the motion for a temporary <br /> restraining order from the Strenger- Corporation; d/b/a Chick 's <br /> Billiards because "the court has considerable reservations as to the <br /> likelihood that plaintiff will prevail on the merits of this action <br /> when the facts are viewed in light of established precedents" , which <br /> the Manager said would compel Chick ' s owners to abide by the City <br /> ordinance which permits all recreational establishments to remain open <br /> only until 1 :00 A.M. while their litigation against the City is in <br /> progress . <br /> Other agenda addendum included information on the Fire Department <br /> program on chimney safety, a change order on the bridge project, a <br /> proposed resolution aut:iorizing the purchase of a front end loader <br /> tractor and a report on the bids taken for reroofing the water treat- <br /> ment plant and the Old City Hall/Fire Station. <br /> Dir. Hamer reported that, because of top soil salvage , the City <br /> realized a savings of $1 , 680 on the St. Anthony Boulevard Bridge <br /> Project which requires a change order approval. <br /> Motion by Mayor Pro Tem Ranallo and seconded by Councilman Enrooth <br /> • to approve Change Order #1 for $1, 680 for the St. Anthony Boulevard <br /> Bridge Project. <br /> Motion carried unanimously. <br /> The Public .Works. Director said he is certain the bridge can be opened <br /> Friday, October 28th and the Manager indicated he mould inform the <br /> Council members as to the time when the ribbon cutting ceremony is <br /> scheduled. <br /> The City desires to purchase a 1974 International front end loader <br /> tractor for $2 , 2.00 from the Federal Surplus program, according to <br /> Mr. Childs who said with this purchase the -City would be able to <br /> replace the 1954 vintage machine which is worn out. Mr. Hamer added <br /> that the cost of the new machine c.an. be taken from saving sand <br /> reclaimed from sealcoating for use this winter. <br /> Motion by Councilman Letourneau and seconded by Councilman Enrooth <br /> to adopt the resolution which authorizes the transfer of funds in the <br /> Public Works Department budget for the purch,a-se. of a front end loader <br /> tractor. <br /> RESOLUTION 82-04.9 <br /> A RESOLUTION MODIFYING THE 1982 BUDGET <br /> Motion carried unanimously. <br />
