Rein Company had acceded <br /> to staff's insistence that the City's lease for the former LaBelle space would <br /> include the provision for the City canceling.the lease without a penalty if the <br /> state legislature would make changes in the existing law which would allow a <br /> grocery or drug store in the same .shopping center to sell strong beer or wine and <br /> precluded the City's right to issue permits for such sales. He also said the <br /> lease addition gave the City the right to withdraw from the lease if the Country <br /> Store next door closed, even though another grocery store should replace them <br /> next to the liquor store. <br /> Mr. Childs indicated the City Attorney had reviewed the new lease, was very happy <br /> with the changes and recommended Council approval after all changes had been <br /> initialed. <br /> Mr. Nelson told Councilmember Enrooth he had not heard any rumors about the possibility <br /> of a liquor store replacing a store on the Minneapolis side of Stinson near the <br /> City's new operation but had heard the owner of the store on the corner of 37th <br /> Avenue N.E. and Old Highway 8 was considering such an operation in that area. <br /> Mr. Nelson concluded his report by saying he would be certain the existing air <br /> conditioning and heating equipment in the store was satisfactory before the lease <br /> would be signed. <br /> The Chair Pro Tem complimented the Liquor Manager on his success in accomplishing <br /> what had originally been perceived as an almost impossible endeavor. <br /> • Motion by Councilmember Enrooth and seconded by Chair Pro Tem Ranallo to approve <br /> the proposed lease with the C. G. Rein Company for approximately 9,100 square <br /> feet of space next to the Apache Country Store subject to the concurrence of the <br /> City Attorney with the final document. <br /> Motion carried unanimously. <br /> Mr. Childs indicated seven vendors had been invited to submit bids for a walk-in <br /> cooler for the new store and only two had responded with only one meeting the <br /> City's fixture specifications. Since those bids had been closed, the Manager said <br /> staff had ascertained two 5 hp rather than one 10 hp compressor was needed and <br /> each bidder had been given the opportunity of including that change in his firm's <br /> bid. National Store Fixtures had increased their bid by $900 while St. Cloud <br /> Restaurant Supply added $1,500 which left National Store Fixtures with the lowest <br /> bid of $44,200 at the same time they met the City's specification requirements. <br /> The manner in which the staff had handled the reopening of the bids had met with <br /> the approval of the City Attorney, the Manager told the Mayor Pro Tem and he <br /> indicated they had been assisted by Lynn Griffiths who had helped to draw up the <br /> specifications and had reviewed them for the City. <br /> Motion by Councilmember Makowske and seconded by Councilmember Enrooth to accept <br /> the bid of $44,200 from National Store Fixtures for the walk-in cooler and accessories <br /> for the new Apache liquor store with the contract to be awarded only upon comple- <br /> tion of the signing of the lease for that space. <br /> Motion carried unanimousl-y.,. <br /> Mr. Childs told Mr.Nelson he would expect the contract to be awarded within a week <br /> which should not interfere with his planned opening September 1st. <br />
