-6- <br /> Motion carried unanimously. <br /> • Mr. Childs indicated he viewed the requests from Rick Johnson for <br /> three adjustments to the Johnson Manor and Belden Terrace Additions <br /> as providing only "fine tuning" for the subdivision. In noting <br /> the absence of the two neighbors who had raised questions about <br /> the project during the Commission hearing , the Manager said he <br /> assumed they had not returned to the second consideration of <br /> the request because their questions related to the subdivision <br /> amendments had been satisfactorily answered during the hearing <br /> and their concerns about unrelated matters might be unanswerable. <br /> Councilmember Ranallo reported receiving calls from the same <br /> persons questioning the purpose of the storm sewer which the <br /> City would be installing to drain the property. The Councilmember <br /> said he believed he had been able to calm any fears they had <br /> in that regard by repeating what he had learned from staff related <br /> to just what the storm sewer was designed to do to alleviate <br /> the flooding that area had experienced in the past. <br /> In regard to the same neighbors concerns about the lighting and <br /> hours of operation of the tennis courts the developer is providing <br /> for the subdivision, the Mayor said he perceived the homeowners <br /> association would have better control over those courts than <br /> the City has now over the public tennis courts next to City Hall, <br /> which are an annoyance to the residents across Silver Lake Road <br /> because they are open all night. <br /> • Mr. Johnson reiterated that he did not plan to light the courts <br /> and, as an adjacent property owner would also prefer they not be <br /> lighted at all . The applicant touched briefly on the reason <br /> he had to take a small piece of land from Lot 11 , saying it was <br /> necessary to correct a mistake he had made in siting his new <br /> garage on Lot 10. <br /> Motion by Councilmember Marks and seconded by Councilmember Makowske <br /> to approve the request from Rick Johnson, 3306 Belden Drive, for <br /> amendments to the Johnson Manor and Belden Terrace Second Addition <br /> subdivisions, Hennepin County, as follows: <br /> 1 . Division of Outlot B, Johnson Manor, into two parcels relating <br /> to siting of tennis courts; <br /> 2. Provision of a 10 foot utility easement on Lot 1 , Johnson Manor; <br /> and <br /> 3. Transfer of approximately 495 square feet from Lot 10 Belden <br /> Terrace Second Addition to Lot 11 of the same subdivision. <br /> In granting approval , the Council finds , as did the Planning Commission, <br /> that: <br /> 1. In siting of the tennis court should be considered nothing more <br /> than a .method for Mr. Johnson to retain ownership of a portion <br /> • of his own property; <br /> 2. The 10 foot utility easement is necessary for a storm sewer installa- <br /> tion; <br />
