Anthony could continue not to assess for <br /> street repairs considering the future expense of repairing <br /> the numerous concrete streets in the City, some of which are <br /> apparent even now. Council Member Makowske pointed out that <br /> the same problems will arise with the asphalt streets . <br /> City Attorney Soth reminded the Council that although it was <br /> legal to assess that the City would be limited by the amount <br /> of the special benefit conferred to the property assessed. <br /> Council Member Enrooth asked whether, if one side of a street <br /> were repaired, the benefit was conferred to only the property <br /> owners on that half of the street. Mr. Soth responded that <br /> that was not necessarily the case, and that formulas could be <br /> established to reasonably allocate benefits . <br /> Council Member Ranallo expressed concern that those property <br /> owners on non-State Aid streets would be unfairly burdened <br /> with large assessments . City Attorney Soth said that in a <br /> technical and legal sense it was irrelevant whether a road <br /> • was State Aid funded or not , because the City could only <br /> assess the benefit, not the cost. He stated that assessments <br /> are not limited by the sources of the funding, and the issue <br /> is one of City policy. <br /> Jones Discusses RCWD and Sidewalk Issues <br /> Douglas Jones informed the Council that Public Works Director <br /> Larry Hamer is to meet on June 29th with representatives of <br /> the City of New Brighton and the Rice Creek Watershed <br /> District' s (RCWD) engineering firm to discuss the grant <br /> project proposed by the RCWD which needs municipal support of <br /> the affected communities . The RCWD will be asking for $3, 000 <br /> to $4, 000 from each municipality and the lake association to <br /> participate in the grant project. He noted that, as an <br /> alternative to the up-front contribution from each community, <br /> state law provides that any watershed district can be <br /> requested to make the necessary improvements and levy the <br /> cost over the entire watershed district up to one third mil <br /> for a period of 15 years . <br /> Mr. Jones advised the Council that Silver Lake is heavily <br /> impacted by runoff, particularly from Apache Shopping Center, <br /> and said that St. Anthony could request that that problem be <br /> dealt with immediately, whereas the grant project is looking <br /> at doing a two-year feasibility study. <br />
