I REGULAR COUNCIL MEETING 2 APRIL 28 , 1992 PAGE 9 4 5 6 Motion by Fleming, second by Ranallo to deny the request 7 of the owner of Sheik ' s Garden Restaurant for a 8 conditional use permit . 9 10 The Mayor stated his lack of support for the request is it based on the history of problems which have been 12 experienced in Apache Plaza with similar amusement 13 devices . He feels that this type of activity generates 14 extra police calls , is not desirable for public 15 convenience and has a negative impact on the welfare of 16 the City. 17 18 Marks inquired if there is a mix of adult and children 19 amusement devices . Knutson responded that is the plan . 20 The Mayor stated he had no problem with kiddy amusement 21 devices only, but could not support the fifteen adult 22 amusement devices being requested. Fleming had concern 23 with the " family environment" section of the application . 24 25 Knutson reviewed the floor plan again. He noted the 26 proposed placement of the amusement devices . It was his 2_7 opinion that the economics to make the operation viable were very difficult and that the devices would aid in the _ economics . 30 31 Wagner .stated he had met with Mr . Alwan and requested he 32 decrease the number of amusement devices being requested. 33 34 Marks recalled that the Malt Shop had pool tables which 35 tend to attract the undesirable element about which the 36 Council appears to be concerned. Knutson inquired if the 37 Council would consider a modification of the request . 38 39 Mayor Ranallo responded that the purpose of the Council 40 is not to negotiate . He also noted that presently there 41 are four machines on the premises and only authorization 42 for three has been given. It was noted that one is not 43 operable. 44 45 Mary Ann Kuharski , 2709 Pahl Avenue, stated her 46 opposition to granting of the conditional use permit . She 47 is not supportive of having twenty-three amusement 48 devices on the premises . She felt there is a safety 49 factor which should be considered and questioned who this 50 establishment is interested in attracting. 51 52 Mr . Alwan felt the restaurant and the amusement devices would be beneficial for the mall .
