City Council Regular Meeting Minutes <br /> March 23, 2004 06 <br /> Page 6 <br /> 1 The Tires Plus representative indicated outside storage of a vehicle would be a rare occurrence, <br /> 2 as there were eight bays within the Tires Plus building. He explained the Tires Plus' policy was <br /> 3 to bring vehicles into the shop every night for security and safety reasons. He noted sometimes <br /> 4 Tires Plus would give an estimate to repair an"undriveable"car and the owner would decide it <br /> 5 needed to be towed to a junkyard; however, situations like that were exceptional. <br /> 6 <br /> 7 Councilmember Stille noted the conditional use permit was connected to the land and not the <br /> 8 business; therefore, he would rather"keep it tight,"with the option to consider modifying it at a <br /> 9 later date if Tires Plus found a need for an adjustment and chose to request it. <br /> 10 <br /> 11 The Tires Plus representative asked Councilmember Stille if he agreed with the 72-hour <br /> 12 allowance. Councilmember Stille responded he did not agree; however, on the other hand,he <br /> 13 did not want to adversely affect Tires Plus' business. <br /> 14 <br /> 15 The Tires Plus representative stated he could not give an opinion regarding whether or not a <br /> 16 vehicle would ever be outside;however,he felt flexibility from Council was needed. He <br /> 17 indicated Tires Plus' policy was to bring vehicles indoors at night. He added someone could <br /> 18 drop off their car and put the keys in the night drop and Tires Plus would not know it was there <br /> 19 until the next morning, for example. <br /> 20 <br /> 21 Councilmember Stille noted it would be difficult for staff to monitor"what cars were where <br /> 22 when" if the 72-hour condition were allowed. The Tires Plus representative responded that Tires <br /> 23 Plus had been located in the City for many years and it had never received complaints regarding <br /> 24 this situation. He indicated he was flexible but also wished for a stipulation of flexibility within <br /> 25 the resolution that would cover the uncommon situations. <br /> 26 <br /> 27 Mayor Hodson requested the resolution move forward as it was written,with the understanding <br /> 28 that Council was receptive to alterations if Tires Plus came forward indicating that market <br /> 29 conditions had changed. <br /> 30 <br /> 31 Motion by Councilmember Faust, seconded by Councilmember Thuesen,to adopt Resolution <br /> 32 04-030, approving a conditional use permit and an administrative subdivision request from Tires <br /> 33 Plus, for property described as Lot 8,Block 7, Mounds View Acres Second Addition(located <br /> 34 next to Twin City Federal on Silver Lake Road), with the stated conditions. <br /> 35 <br /> 36 Discussion: <br /> 37 <br /> 38 Councilmember Horst stated he wished to amend the conditional hours of operation to 7:00 a.m. <br /> 39 to 10:00 p.m. on weekdays and 7:00 a.m. to 7:00 p.m. on weekends, which would allow Tires <br /> 40 Plus flexibility if they needed to be open beyond the currently cited hours. <br /> 41 <br /> 42 Councilmember Faust responded he did not accept Councilmember Horst's amendment as a <br /> 43 friendly amendment. <br /> 44 <br />
