y �"r <br /> ACRE RMNT <br /> • THIS AGRIORC T made and entered into this day of <br /> 1980, by and between the City of St. Anthony, a <br /> Minnesota municipal corporation ("St. Anthony"), and Dick's Sanitary <br /> . j <br /> Service, Inc./Brooklyn Recycling, a Minnesota corporation("Purchaser"). <br /> WITNESSETH THAT: ' <br /> i <br /> WHEREAS, St. Anthony operates a depot for the collection of bi-metal <br /> - i <br /> cans, aluminum, glass bottles and jars of any color, newspapers, and other <br /> recyclable pater products :(herein called "Recyclable Materials") for the <br /> purpose of recycling; and <br /> WHEREAS, Purchaser desires to purchase said Recyclable Materials. <br /> NOW, THEREFORE, for and in consideration of the mutual agreements <br /> i <br /> herein contained, the parties hereto agree as follows: r <br /> 1, St. Anthony, agrees to: <br /> a. Operate a recycling depot within the cow-porate limits of <br /> St. Anthony, Minnesota, for the collection of Recyslable Materials, the I' <br /> location of and hours of business of such depot to be determined by <br /> St. Anthony; <br /> b. Employ such personnel as St. Anthony deems desirable or <br /> necessary for adequate staffing of ',the depot; <br /> c. Maintain the depot, except equipment and vehicles owned <br /> by Purchaser, at its expense in such condition and to such extent as <br /> St. Anthony deems desirable or necessary. <br /> d. Use its best efforts to sort and separate Recyclable <br /> Materials in the manner requested by ,Purchaser. <br /> c ; <br /> e.
