RES 82-056 RESOLUTION APPROVING CERTAIN CITY OF ST. ANTHONY PROPERTY FOR PUBLIC AUCTION

AGREEMENT • THIS AGREEMENT by and between the City of St. Anthony, Minnesota, a municipal corporation, hereinafter referred to as the "City" , and the County of Ramsey , a political subdivision of the State of Minne- sota, hereinafter referred to as the "County" ; WITNESSETH: WHEREAS , the City and the County desire to construct and rebuild County Road D/37th Avenue Northeast (County State Aid Highway 19) from Silver Lake Road to I-35W; and WHEREAS , this proposed project scheduled for construction contract award in 1983 .includes , among other things ,_ a sidewalk on the north side of County Road D; and WHEREAS , the improvement of County Road D and the construction of this sidewalk requires the acquisition of additional permanent right-of-way and easements; and WHEREAS , the City has been allocated CDBG funds for the acquisi- tion of right-of-way and construction of a sidewalk on the north side of County Road D from Macalaster Drive to Foss Road; and • WHEREAS , the CDBG funds require that the acquisition of land comply with the provisions of the Uniform Relocation and Acquisition of Real Property Act; and WHEREAS , the City and County agree that the acquisition of land and construction of improvements on County Road D coordinated by the County will be in the best interest of both parties ; and WHEREAS , the improvement of County Road D' will require cost participation by the City. NOW, THEREFORE, IT IS HEREBY. MUTUALLY AGREED AS FOLLOWS : (.1) The City shall contribute to the Treasurer of the County CDBG funds an amount not to exceed $22 , 877 .00 . The City shall contri- but to the Treasurer of the County CDBG funds estimated to be $22 , 877 .00 , upon completion of the acquisition in accordance with the uniform act and followin,g. review and approval of the acquisition documents by the City. (2) The City hereby designates the County as its agent for the purposes of acquiring right-of-way and construction of a sidewalk between flacalaster Drive and Foss Road; provided, however, that the County shall have no authority to incur costs or obligations of the City in excess of the amount specified in paragraph ( 1) . (31 The right-of-way shall be acquired in the name of the County.
