AGREEMENT FOR PRELIMINARY ENGINEERING THIS AGREEMENT made and entered into this day of , 1985 , by and between the City of Columbia Heights , Minnesota, a municipal corporation , hereinafter called "Columbia Heights" , and the City of St . Anthony, Minnesota, a municipal corporation, hereinafter called "St . Anthony" . WITNESSETH: WHEREAS Columbia Heights has the facilities through its Engineering Department to make complete surveys , prepare plans , and prepare specifications , together with the necessary soil studies for the proposed concrete panel replacement , slab jacking and joint/ crack sealing of the intersection of 37th Avenue North East and Stinson Boulevard North East , and WHEREAS it is advantageous to St . Anthony and Columbia Heights to share the cost of such plans , NOW THEREFORE , it is hereby agreed : ( 1 ) Columbia Heights , in consideration of the provisions herein contained , shall , through its City Engineer, make the necessary engineering surveys and studies , assemble the necessary data, and • prepare plans for the replacement of concrete panels , slab jacking and joint/crack sealing of the intersection of 37th Avenue North East and Stinson Boulevard North East . (2) St . Anthony and Columbia Heights shall share the cost of such plans based upon the percent of paved area in the intersection contained within each city. (3 ) That the estimated cost of the St . Anthony share of such preliminary engineering is $500 .00 based on 1 .2% of the work being in St . Anthony. The maximum cost of such preliminary engineering will not exceed the M.S.A .S . guidelines establishing the maximum reimbursable preliminary engineering costs . If it appears that the actual cost of such preliminary engineering will exceed said estimated cost , Columbia Heights shall immediately notify St . Anthony in writing thereof. The City Council of St . Anthony agrees to act on said notice 15 days of receipt , and after approval by the City Council of St . Anthony and notification thereof to the City Council of Columbia Heights , said action will have the effect of amending this agreement so as to include a new estimated cost of such preliminary engineering.
