JOINT POWERS AGREEMENT <br /> • <br /> HAZARDOUS MATERIALS RESPONSE VEHICLE <br /> This agreement made and entered into this day of , 1986 <br /> by and between the Cities of Fridley, Columbia Heights, St. Anthony, and Coon <br /> Rapids, each being a Minnesota municipal corporation, and the Spring Lake Park <br /> Fire Department, Inc. (hereinafter called "SBM") a non—profit Minnesota <br /> corporation; <br /> WHEREAS, each party to this agreement desires to have for its use a <br /> specially equipped emergency vehicle designed to carry equipment and supplies <br /> necessary for the abatement and/or containment of hazardous materials leaks <br /> and spills, and special personnel protective equipment needed for such <br /> purposes; and <br /> WHEREAS, it is more economical for each party to share the costs of one <br /> such equipped vehicle rather than each party purchasing, equipping and <br /> maintaining its own such vehicle; and <br /> WHEREAS, the Cities of Fridley, Columbia Heights, St. Anthony, and Coon <br /> Rapids and SBM on behalf of the Cities of Spring Lake Park, Blaine and Mounds <br /> View are authorized to enter an agreement for the ,joint and cooperative <br /> exercise of powers common to them pursuant to Minnesota Statutes 471.59 et <br /> • seq., <br /> NOW, THEREFORE, in consideration of the mutual covenants herein recited, <br /> it is agreed that: <br /> 1. Joint Financing and Management of Bazardous Materials Response Vehicle. <br /> Each party will share on as equal a basis as practical, the cost of <br /> initially retrofitting and equipping an emergency hazardous material <br /> response vehicle ("HMRV"). For this purpose the designated <br /> representative of each party shall confer on the costs related thereto <br /> and submit their pro rata cost to the financial disbursing officer for <br /> each party. Payment by each party of its pro rata share shall be to a <br /> purchasing officer selected by the parties. <br /> Management of the vehicle, that is, selection of supplies and equipment, <br /> exterior vehicle color and markings, configuration and type of all <br /> equipment mounted on and within the HMRV, and all other day to day <br /> operational activities needed to fully implement this agreement, is <br /> vested in an Operations Committee composed of representatives selected by <br /> each party. Recommendations and/or decisions by the Operations Committee <br /> are subject to ratification or recission by collective action of the Fire <br /> Chiefs for each party to this agreement. <br /> • —1— <br />
