The requested rezoning would be in effect recognizing and <br /> legalizing a present non-conforming use. <br /> • The motion carried with Springer opposed. <br /> The Chairman announced that this was the time and place to hold a public <br /> hearing on the request of .john Wakiriak to rezone the 183 feet residential <br /> strip lying South of the center line of Sil -ver Lane from Stinson Boulevard <br /> to Silver Lake Road from R-1 to R-2, two family residential . <br /> Curtis Englund stepped down as a member of the Board and abstained from <br /> voting as a neighboring property owner. <br /> After hearing all the comments and discussion from all of the persons <br /> involved,the hearing was declared closed by Chairman Coulter. <br /> Upon motion by Springer, seconded by Mesenbring, it was moved to defer <br /> action on the requested rezoning pending further study by the Board. <br /> The motion carried with Englund abstaining. <br /> Englund returned as member of the Planning Board. <br /> The Chairman announced that this was the time and place to hold a public <br /> hearing on the request of Max Saliterman to rezone the property at 2550 <br /> Kenzie Terrace from R-1 , single family to Commercial . <br /> After hearing all the comments and discussion from all of the persons <br /> • involved, the hearing was declared closed by Chairman Coulter. <br /> Upon motion by Springer, seconded by Howitz, it was moved to recommend <br /> that the Council deny the requested rezoning on the following basis: <br /> a. The zoning as requested would constitute spot zoning which is <br /> not in keeping with the past policy of the Planning Board. <br /> b. The requested zoning would be an encroachment into the small <br /> residential area along Kenzie Terrace further reducing its now restrictive <br /> size. <br /> c. Any rezoning in this area should be done only after careful study <br /> of the entire area along Kenzie Terrace. <br /> The motion carried unanimously. <br /> 5. ORDINANCES bARIATIONS <br /> Upon motion by Englund, seconded by Howitz, it was moved to recommend <br /> that the Council approve a variance from 25 feet to 12 feet on the rear <br /> yard requirement of lot 9, Block 1 , St. Anthony Terrace Manor ( 3424 Croft) <br /> as requested by Elmer Peterson. <br /> The motion carried unanimously. <br /> • <br /> 1 _ <br />
