Planning Commission Regular Meeting Minutes <br /> August 16, 1994 <br /> Page 11 <br /> 1 Commissioner Faust questioned the ability to screen a lumber yard from a three story <br /> 2 apartment building. He asserted that vague language may allow law suits, not more <br /> 3 latitude. <br /> 4 Commissioner Franzese questioned whether the Commission has enough information to <br /> 5 reach a decision tonight and called for the vote. She noted that the Commission's minutes <br /> 6 will reflect their concerns regarding a lumber yard. <br /> 7 Voting on the motion: <br /> 8 Aye: Bergstrom and Makowske <br /> 9 Nay: Faust, Franzese, Gondorchin and Thompson <br /> 10 Abstain: Horst <br /> 11 Motion failed, <br /> Motion by Faust to recommend denial of an amendment to the City's current ordinance, <br /> *3 Section 1635.03,permitted uses, to allow a lumber yard business in conjunction with a <br /> 14 hardware/building supply store to apply for a conditional use permit in the Commercial <br /> 15 District based on the rationale that a lumber yard is not consistent with permitted and <br /> 16 conditional uses as defined in the Zoning Ordinance. <br /> 17 Chair Gondorchin asserted this motion is not needed and declared it to be out of order. <br /> 18 Commissioner Franzese restated some of the Commission's concerns as being: <br /> 19 1. The Commission does not have enough information concerning liability issues for <br /> 20 the City. <br /> 21 2. The Commission is unsure how to include proper and adequate restrictions for a <br /> 22 conditional use of this type. <br /> 23 3. The Commission feels a lumber yard use, in certain configurations, may not be <br /> 24 compatible. <br /> 25 Commissioner Horst indicated that while he abstained from the discussion and vote,he <br /> 26 will represent the Commission's concerns to the Council as stated. <br /> 27 Chair Gondorchin urged the petitioner to attend the City Council meeting on August 23, <br /> 1994, for the Council's decision of the ordinance.amendment request. <br />
