Planning Commission Regular Meeting Minutes August 16, 1994 Page 11 1 Commissioner Faust questioned the ability to screen a lumber yard from a three story 2 apartment building. He asserted that vague language may allow law suits, not more 3 latitude. 4 Commissioner Franzese questioned whether the Commission has enough information to 5 reach a decision tonight and called for the vote. She noted that the Commission's minutes 6 will reflect their concerns regarding a lumber yard. 7 Voting on the motion: 8 Aye: Bergstrom and Makowske 9 Nay: Faust, Franzese, Gondorchin and Thompson 10 Abstain: Horst 11 Motion failed, Motion by Faust to recommend denial of an amendment to the City's current ordinance, *3 Section 1635.03,permitted uses, to allow a lumber yard business in conjunction with a 14 hardware/building supply store to apply for a conditional use permit in the Commercial 15 District based on the rationale that a lumber yard is not consistent with permitted and 16 conditional uses as defined in the Zoning Ordinance. 17 Chair Gondorchin asserted this motion is not needed and declared it to be out of order. 18 Commissioner Franzese restated some of the Commission's concerns as being: 19 1. The Commission does not have enough information concerning liability issues for 20 the City. 21 2. The Commission is unsure how to include proper and adequate restrictions for a 22 conditional use of this type. 23 3. The Commission feels a lumber yard use, in certain configurations, may not be 24 compatible. 25 Commissioner Horst indicated that while he abstained from the discussion and vote,he 26 will represent the Commission's concerns to the Council as stated. 27 Chair Gondorchin urged the petitioner to attend the City Council meeting on August 23, 1994, for the Council's decision of the ordinance.amendment request.
