Planning Commission Regular Meeting Minutes <br /> • January 20, 1998 <br /> Page 2 <br /> 1 Ms. Moore-Sykes reported that City Staff has received a request from Tony Farald, owner of the <br /> 2 Conoco gas and convenience store at 3259 Stinson Boulevard, for a six foot side yard variance in <br /> 3 order to put a roof and door on an enclosure that is attached to the principal structure.on the north <br /> 4 side to store recyclable items and milk crates. Currently, the area is walled in, similar to an <br /> 5 enclosure used for dumpsters. <br /> 6 Mr. John Seviola, of Seviola Construction Co., appeared before the Planning Commission at a <br /> 7 concept review in December and presented Mr. Farald's proposal for the gas station at 33rd and <br /> 8 Stinson. The current enclosure is already 6 feet into the side yard setback. Mr. Seviola reported <br /> 9 that they store used plastic milk cartons, recyclables and other miscellaneous items in the - <br /> 1-0 enclosure that-already exists on this side of the building. But because of many instances of <br /> 11 vandalism, they want to put a roof on it and install an 8 foot door. With these proposed changes, <br /> 12 the enclosure becomes part of the principal structure. <br /> 13 Once the structure is enclosed, it becomes part of the principal structure and the modification <br /> 14 requires the owner to obtain a six foot side yard variance. The enclosure is currently 6 feet into <br /> 15 the side yard and this current condition is what they are requesting a variance for. The structure <br /> 16 was constructed in 1962 and the City Zoning Ordinance was codified in 1976. Because of the <br /> 17 later changes in the Ordinance,the building was allowed to exist as a grandfathered in structure <br /> 4P until such time as it was removed or modified. The hardship for this variance is the change in the <br /> Ordinance that'established side yard setbacks that are more restrictive than existed at the time the <br /> 20 building was constructed. <br /> 21 Mr. Farald hopes that this limited access, enclosed storage area will resolve the public health <br /> 22 issues that continually arose when items in the current enclosure were scattered all over the area <br /> 23 and neighborhood. <br /> 24 Commissioner Gondorchin questioned if the enclosure was built in 1962. He suggested that an <br /> 25 older structure had been demolished and the current enclosure was constructed in 1972 or 1974. <br /> 26 Ms. Moore-Sykes stated the 1962 building permit was all she could find in regard to an enclosure <br /> 27 on the property. <br /> 28 Commissioner Makowske asked if the six foot variance request was in addition to the current six <br /> 29 foot non-conforming setback. <br /> 30 Ms. Moore-Sykes explained that the variance request was for the existing six feet which is <br /> 31 located in the side yard setback. The variance is required because once the structure is enclosed, <br /> 32 it becomes part of the principal structure. <br /> John Seviola, Seviola Construction Co., displayed a site plan of the proposal. He explained Mr. <br /> 49 Farald would like to put a roof on the enclosure because of vandalism and the storage of garbage <br /> 35 and recyclables. Mr. Farald prides himself on a clean store and area. <br />
