He noted that if the dumpster would not fit, they will <br /> 3 obtain a smaller dumpster. The intent is that all garbage,recyclables, etc. will be enclosed. <br /> 4 Commissioner Makowske asked the dimensions of the lot. <br /> 5 Mr. Seviola stated the lot is 150 feet on the 33rd Avenue side and 100 feet on the Stinson <br /> 6 Boulevard side. <br /> 7 Chair Bergstrom closed the public hearing at 7:10 P.M. <br /> 8 Commissioner Makowske stated Staff did a good job of analyzing this proposal and the concept <br /> 9 review in December makes the determination easier. He suggested that if the variance request is <br /> 10 recommended for approval the hardship must be clearly defined. He noted that'a hardship is <br /> 11 generally based on the physical characteristics of a lot. In this case, the hardship is a legal non- <br /> 12 conforming structure which was built before the City Codes were in effect and also the concern, <br /> 13 of public health and safety with the garbage and the vandalism. <br /> IR Motion by Commissioner Makowske, seconded by Chair Bergstrom, to recommend approval of <br /> a side yard setback variance of 6 feet for the property located at 3259 Stinson Boulevard, City of <br /> 16 St. Anthony, based on the hardship that: <br /> 17 1. The current structure is a legal non-conforming structure which was in place when the <br /> 18 City's Zoning Ordinance was codified in 1976 and that the imposition of that City <br /> 19 Ordinance restricted the ability of this grandfathered structure to make any adequate <br /> 20 improvements for the purpose of public health and safety; <br /> 21 .2. It was indeed the City Ordinance that imposed the hardship; and <br /> 22 3. The property is unique in so far as the structure was already in place when the City <br /> 23 Ordinance went into effect. <br /> 24 <br /> 25 Motion carried unanimously. <br /> 26 <br /> 27 Chair Bergstrom-noted this request will be'considered by the City Council at their January 27, <br /> 28 1998 meeting. <br /> 29 2. Subdivision of Property:: Chazin. <br /> 30 Chair Bergstrom opened the public hearing at 7:15 P.M. <br /> 31 Ms. Moore-Sykes reported City Staff has received a request from Alan Chazin, Alan Chazin <br /> Homes, Inc., buyer of the property located at 3301 Stinson Boulevard to subdivide and replat this <br /> property.
