Planning Commission Regular Meeting Minutes <br /> • January 20, 1998 <br /> Page 4 <br /> 1 four owner-occupied townhomes on this site. The property is currently zoned R-3, which is a <br /> 2 district zoned to allow for the construction of townhomes. <br /> 3 The proposed project meets the area, lot size and setback requirements of the City Ordinance for <br /> 4 this zoning district. There exists a 20 foot utility easement on the east side of the property, which <br /> 5 Mr. Chazin is aware of and has so noted that easement on the preliminary plats. These <br /> 6 preliminary plats, as well as the title commitment have been submitted to the City Attorney for <br /> 7 his review. <br /> 8 Since this project meets all the requirements of the City's Zoning Ordinance,for this zoning <br /> 9 district, it appears to be a project well suited to the area. Staff has not received any calls or <br /> 10 letters from the surrounding area regarding this project. In discussing drainage issues with Staff, <br /> 11 Mr. Chazin indicated that he will grade the site so that most of the storm water is retained on site <br /> 12 or drained away in such a manner as to prevent any impact on neighboring properties. <br /> 13 Ms. Moore-Sykes noted a letter received from City Attorney Soth dated January 19, 1998, which <br /> 14 indicates that for the most part the proposal meets his satisfaction in regard to the legal aspects. <br /> 15 Commissioner Gondorchin questioned points 5. Lot Coverage and 8. Easements c., of the City <br /> 0 Attorney's letter. <br /> 17 Ms. Moore-Sykes stated she had spoken with Mr. Chazin when the site plan was reviewed in <br /> 18 regard to the maximum lot coverage of 50%and he indicated he would make sure that the <br /> 19 proposal was well within the 50% lot coverage allowed. At the time of submission to the City <br /> 20 Attorney there was no indication of the square footage. Ms. Moore-Sykes reported she had <br /> 21 spoken with Mr. John Baker, Architect, today and he had indicated that he would provide further <br /> 22 information in regard to this issue. <br /> 23 Ms. Moore-Sykes stated that in regard to the easements of record for public roads over the west <br /> 24 33 feet(Stinson Boulevard) and the south 33 feet(33rd Avenue NE), City Attorney Soth had no <br /> 25 further comments. She noted there may be a problem with snow removal. If landscaping is <br /> 26 installed on these easements it may be damaged during snow removal and also if the utilities in <br /> 27 the street easements needed to be accessed. <br /> 28 Commissioner Gondorchin questioned the City's liability for these damages. <br /> 29 Ms. Moore-Sykes stated the City would not be liable for the damages. The owner would be <br /> 30 advised not to install landscaping in these areas. <br /> 31 John Baker, Architect, displayed a site plan of the proposal. He noted the total square footage of <br /> the lot is 16,500 square feet. The proposal includes 8,246 of hard cover including all impervious <br /> surfaces, which is less than 50%. In regard to the 33 foot easement, Mr. Baker noted that <br /> 34 according to survey, this easement is from the center line on 33rd Avenue and Stinson <br />
