STAFF REPORT <br /> DATE: January 21, 1997 <br /> TO: Planning Commission Members <br /> FROM: Kim Moore-Sykes, Management Assistant <br /> ITEM: Proposed Amendment to Chapter 16, Section 1635.05 of the <br /> St. Anthony 1993 Code of Ordinances <br /> BACKGROUND: <br /> In an attempt to facilitate the redevelopment of commercial areas in St. Anthony, the City <br /> proposes to amend Chapter 16, Section 1635.05 of the St. Anthony 1993 Code of <br /> Ordinances. This change is being proposed to allow for the unique circumstances created by <br /> current redevelopment strategies and efforts being utilized in commercial areas. <br /> The current setback requirements of the Zoning Ordinance seem to be creating an <br /> impediment to these redevelopment efforts, causing the request of several variances to be <br /> granted. It is the intent of the City to allow for the orderly and logical redevelopment of its <br /> commercial areas, while at the same time allowing redevelopment to occur in a controlled <br /> manner. <br /> The following is being proposed as Subdivision 8. <br /> Subd. 8. Shopping Centers. The minimum yards set forth in this Section <br /> 1635.05 will not apply to any lot line of a lot in a shopping center if (i) the lot <br /> lines adjoins either another lot within the-shopping center or a driveway or <br /> parking area within the shopping center, and (ii) the Council has approved a <br /> site plan for a building to be constructed on the lot with a different setback <br /> from such lot line. In such cases, the setback approved by the Council shall <br /> apply so long as the building exists on the lot. <br /> For purposes of this subdivision, a "shopping center" is defined as any group <br /> of four or more retail or service establishments on one or more contiguous <br /> tracts of land in single ownership, or in multiple ownership but subject to a <br /> reciprocal easement agreement governing common access and parking. <br /> RECOMMENDATION: <br /> Staff recommends the approval of the proposed amendment to Chapter 16, Section 1635.05 <br /> of the St. Anthony 1993 Code of Ordinances by adding Subdivision 8. <br />
